OFFICIAL: Irvine's challenge of his appeal has failed. A VOICES member was in court this morning to witness proceedings. The judge ruled Irvine had no grounds to challenge the outcome of the appeal. Therefore there will be no further appeal and the erasure will remain. More details to follow.

Unfortunately we have now learnt that RI has lodged a challenge to the outcome of his appeal. As a result there will be a further hearing on 24 August to decide whether there are grounds for an appeal to the Court of Appeal. They will also decide whether RI should remain erased or if he should be reinstated to the register of doctors until after his further appeal is heard.

Obviously this is devastating news. We are trying to find out where the hearing will be held. We will update you with any further information and after the hearing.

The outcome of Irvine's appeal is now available on the Bailii.org website. The appeal "fails and is dismissed". Justice has prevailed and Irvine is removed from register of doctors.

It has come to our attention that the judgment in the appeal hearing on Rod Irvine will be given in Court 1 at the High Court London. It will be handed down by Mr Justice Holroyde on Monday 14 August, 2017 at 10.30am. Outcome to follow.

RI's appeal was heard at the hight court in London on Tuesday 13 June 2017. The hearing focused on his lack of insurance. The judge will give his decision in the next few weeks on whether the decision to erase him from the medical register should be upheld or not. We will update you as soon as we hear.

UPDATE Those who attended RI's fitness to practice hearing in July 2016 received the following email today. RI was found to be unfit to practice by a GMC panel with the intention he would be 'erased' from the register. Follow RI lodging an appeal and despite the GMC's wishes he has been allowed to return to work at Kings College Hospital whilst his appeal is heard. It will be heard on 13 June at the High Court.

We are disappointed to report that Irvine has lodged an appeal against his striking off. Not only that the email from the GMC states:

"Irvine made an application to the court for them to set aside the order imposed by the MPT which immediately suspended his registration. The GMC opposed Dr Irvine’s application, but the court agreed to it. Dr Irvine provided an undertaking to the court that he would comply with the conditions previously imposed on his registration by the Interim Orders Tribunal on 21 November 2016. He is therefore free to practise subject to those conditions, until his appeal is decided upon."

We anticipate that this means he will return to Kings College Hospital (KCH) performing coloscopies on unsuspecting women patients. Let Nick Moberley, the CEO of KCH, know what you think about this and ask them not to allow Irvine to work directly with women patients by writing to Nick Moberley at Denmark Hill, Brixton, London, SE5 9RS.

Please share this as widely as you can and encouragilng your friends and family to write to KCH too. Lets all help PROTECT WOMEN PATIENTS
