1954 DRUG AND REMEDIES MAGIC ACT (OBJECTIONABLE ADVERTISEMENTS)
1. Introduction
It is commonly found in India that some persons might be selling some magic remedies like kavachas, mantras, talismans, etc. claiming them to be a universal cure for any disease, etc. Similarly, advertisements in magazines, newspapers and on the premises of certain doctors, hakima or vaids (so called are also found that claim to cure diseases which are not cured by any drug or treatment. Innocent people are always the target of such deception, leading to wastage of time and money, even spoiling their health and sometimes premature death.
1.1 Prohibited Advertisements
The classes of advertisements prohibited under this Act are:
1) Advertisements of drugs used in the following ailments or conditions:
¡) For miscarriage or preventing conception in women
ii) For removing menstrual disorders in women
iii) For maintaining or improving the capacity of sexual pleasure in human beings
iv) For diagnosing, preventing or curing appendicitis, arteriosclerosis, blindness, blood poisoning, cancer, cataract, deafness, diabetes, brain disorders, uterus disorders, disorders of menstrual flow, disorders of nervous system and prostatic gland, dropsy, epilepsy, female diseases (in general), fevers in general, fits, form and structure of female bust, gall stones, kidney stones and bladder stones, gangrene. glaucoma, goitre, heart diseases, high or low blood pressure, hydrocele, hysteria, infantile paralysis, insanity, leprosy,. leucoderma.
2) Advertisements of drug giving false impression about any drug or making false claims for it, or are itself false and deceptive
3) Advertisements of magic remedies, claiming to be efficient in any conditions produced.
