“Wyatt is now facing the unthinkable—not only the possibility of prison for something he did not do, but the fear that his daughter’s legitimate medical issues were misinterpreted or ignored by physicians at Children’s Healthcare of Atlanta, while abuse allegations were pursued instead..”

Yesterday, Wyatt Tallon—a loving husband and father to two young daughters—was indicted on fourteen counts following false allegations from a very familiar hospital and doctors with a not so savvy reputation.

The Tallon family of Cartersville, Georgia urgently needs financial support.
Every dollar donated right now goes directly to Wyatt Tallon’s legal defense, ensuring he has the strongest possible representation as he fights to prove his innocence and stay home with his family.

What makes this especially alarming is who is responsible.

This case is being prosecuted by Whitney Law, operating under District Attorney Erle Newton—the same prosecutorial leadership that previously attempted to imprison each parent in the Timms family of Gordon County, Georgia for 80 years each, based on accusations originating from Children’s Healthcare of Atlanta and the same group of doctors.

Despite the devastating and well-documented harm caused in prior cases, Erle Newton has allowed yet another prosecutor under his authority to pursue another family using the same playbook and your tax dollars.

This is not an isolated incident.
It is a pattern.

Wyatt is now facing the unthinkable—not only the possibility of prison for something he did not do, but the fear that his daughter’s legitimate medical issues were misinterpreted or ignored by physicians at Children’s Healthcare of Atlanta, while abuse allegations were pursued instead.

Multiple independent medical experts have reviewed this case and maintain that the allegations are false and consistent with an underlying medical condition—not abuse. These expert opinions were available, yet prosecution moved forward anyway.

While Wyatt fights for his freedom, his wife Rachel may be left to raise their two young daughters alone.

Families should not have to lose everything to prove their innocence.

There are documented paper trails—including check stubs and payment confirmations—between Georgia Department of Family and Children’s Services and the Stephanie Blank Center for Safe and Healthy Children at Children’s Healthcare of Atlanta, a clinic that specializes in child abuse evaluations. These records demonstrate direct financial relationships and are a clear indication of institutional incentivization, raising serious concerns about why abuse determinations continue to be pursued against innocent families.

And now, the Tallon family is paying the price.

False allegations of abuse fracture families and harm innocent children.

Our latest case in Georgia involves Wyatt and Rachel Tallon. It highlights how the family policing system is plagued by systemic issues like embedded bias, flawed medical practices, confirmed bad actors, and repeated investigative errors.

These problems are often reinforced by circular reasoning, which becomes convincing because repeating mistakes over time makes them seem unquestionable. Prosecutors are not immune; they frequently fall victim to this logical fallacy: After all, if an expert says it’s true, it must be true. Because if they don’t know, then who does?

But what happens when a prosecutor relies on a discredited expert, such as Dr. Stephen Messner from Children’s Healthcare of Atlanta?

Erle Newton, the elected district attorney for the Cherokee Judicial Circuit, did just that. He prosecuted Brady and Carrie Timms based on Dr. Messner’s opinion that their son was abused, even though he had an underlying medical condition with symptoms that mimicked abuse. After the Timms were acquitted, discrediting Dr. Messner, a member of their jury, while walking out of the courtroom, turned to Brady and Carrie and said, “Now go get your son.” By then, the family had been separated for over 1,000 days.

And Mr. Newton is once again relying on Dr. Messner’s opinion. This time to prosecute the Tallons. Like Brady and Carrie’s son, the Tallons’ youngest daughter has a health condition with symptoms that mirror abuse. A condition confirmed by a well-respected orthopedic surgeon.

Carrie Timms, now You Are The Power’s Georgia State Organizer, said:

“The Tallon Family’s nightmare hits too close to home for me; mainly because it’s literally in the same judicial circuit with the same prosecutor and the same accusing doctors. Rachel & Wyatt stood with my family through our trial all the way through the verdict. I grew to love them and could see how devoted they are to their family’s justice. It takes strength to face your accusers during another family’s trial. A strength that could only come from a mother and father who truly want the truth to be told. I stand with them wholeheartedly and cannot wait for this darkness to be exposed once again here in North Georgia.”

Meet the Tallons - Another innocent family torn apart by false allegations.

Wyatt and Rachel Tallon are parents of two beautiful girls and have been falsely accused of abuse by doctors at Children’s Healthcare of Atlanta (CHOA).

The Tallon's youngest daughter, Josie, accidentally fell off the couch. As a precaution and at the family pediatrician’s request, Wyatt and Rachel took her to CHOA. They met Dr. Keely Iannelli, a fellow undergoing specialized training in child abuse pediatrics. Dr. Stephen Messner, a child abuse pediatrician (CAP), did not physically examine Josie, but agreed with Dr. Iannelli’s findings of abuse. Soon thereafter, the Tallons’ lives were turned upside down.

Dr. Iannelli and Dr. Messner misdiagnosed Josie as having been abused, which led to the involvement of law enforcement and Georgia’s Division of Family and Children Services (DFCS). Because of the misdiagnosis, Wyatt and Rachel were arrested, charged with felonies, and Josie was removed from the care of her parents.

These are the same doctors who falsely claimed that parents in Troup County, Georgia, abused their son. The parents' DFCS case and their criminal charges were later dismissed, discrediting both doctors. Dr. Messner is the same CAP who also falsely accused Brady and Carrie Timms of abusing their son. Once again, he was discredited after a jury acquitted the Timms. Brady and Carrie were prosecuted by the Cherokee Judicial Circuit District Attorney’s Office, the same office now prosecuting the Tallons.

Within twenty-four hours of the Timms verdict, DFCS closed its case against Wyatt and Rachel. And since case closure, a well-respected orthopedic surgeon reviewed Josie’s medical records and concluded: “The allegations of child abuse are strongly refuted by the medical history, bone findings at multiple sites, and lab values, which are consistent with inadequate early bone mineralization...” The superior court judge overseeing the Tallon case, the same judge who handled the Timms case, has returned Josie to her parents' care.

Yet, Erle Newton, the elected district attorney, and his staff refuse to acknowledge that Wyatt and Rachel, like Brady and Carrie Timms, are innocent and dismiss the pending criminal charges against them. Mr. Newton is once again relying on Dr. Messner's opinion to prosecute a case.

A Long-Awaited Update on Josie 💜

“These are not and never were fractures.”

Over the past few months, Josie has been seen by multiple medical experts — real specialists who took the time to thoroughly examine her medical history, test results, and imaging. For the first time since this nightmare began, we have a clearer picture of what’s truly going on with Josie’s health.

An expert, after careful review, stated the following in his report:

“The allegations of child abuse are strongly refuted by the medical history, bone findings at multiple sites, and lab values, which are consistent with inadequate early bone mineralization...”

Josie was taken from her home based on a rushed and deeply flawed interpretation of her medical condition. Child abuse pediatricians saw what they assumed were fractures — without considering the full medical picture. But now, respected experts have confirmed what Rachel and Wyatt knew in their hearts all along: This was not abuse.

What happened to Josie and the Tallon family should never happen to anyone. They have been living a parent’s worst nightmare — falsely accused, separated from their daughter, and forced to fight a system that presumed guilt before seeking truth.

A MUST READ ⬇️

“Better safe than sorry.”

“Well, doctors are mandated reporters and are required to report suspected abuse. It’s not their job to investigate or determine whether or not it’s actually abuse, just to report it to CPS.”

“I’m sorry you went through that, but I’m glad they were looking out for your children.”

These are some common responses that families falsely accused by child abuse pediatricians hear. And although these words are likely not intended to be hurtful, they cut deep.

Because what the families on this page have lived through looks entirely different from what most people assume happens in cases of suspected abuse.

And that’s why this page exists. That’s why these stories are shared.

Because many people have never even heard of child abuse pediatricians (CAPs), let alone know that they are actually more than mandated reporters. Unlike other medical professionals, CAPs go beyond just reporting suspected abuse, they also investigate and make diagnoses of abuse. CAPs are often stationed at children’s hospitals and are consulted by (and sometimes contracted with) CPS to determine whether or not abuse has occurred. CPS and law enforcement, who are not doctors, rely heavily on a CAP’s diagnosis of abuse, trusting that a thorough and accurate diagnosis has been made.

The parents who share their family’s stories for this page all fully understand the need to report and investigate things like unexplained fractures in infants to make sure children are protected.

What they can’t understand is a CAP making a diagnosis of abuse, sometimes within just a few hours, before thorough testing can even be run.

They can’t understand why the “better safe than sorry” approach includes blocking access to their children’s medical records, repeatedly denying genetic testing, and in some cases, CAPs making a life changing diagnosis without ever even meeting or physically examining their child.

Is it “better safe than sorry” to deny or delay second medical opinions, which are standard and even recommended in all other areas of healthcare?

Shouldn’t protecting children mean making every effort to arrive at the correct diagnosis for each child?

When parents share their stories, they know they may be met with skepticism and criticism, but it’s because of all of these families bravely speaking out that eyes are being opened to this growing epidemic of medical misdiagnosis by CAPs and the need for better checks and balances in these cases.

Their stories show how easily this can happen to any family. Their stories highlight that this isn’t an issue specific to one CAP or one children’s hospital or even one state. Their stories, together, are identifying the alarming patterns and systemic issues in these cases while also raising critical awareness about rare medical conditions that can mimic abuse.

Their stories matter and deserve to be heard.

Because the sweet mother and son in this picture should have never been separated for 1,174 days.

The Hernandez family has been cleared of all charges—NOT GUILTY on every count. Today, truth prevailed. Justice broke through. And a family torn apart by a broken system is one step closer to healing.

This is the outcome we’ve been praying for. But it didn’t come easy. The Hernandez family endured years of heartache, fear, and an uphill battle against a system that too often fails the innocent. They stood strong. They kept the faith. And today, they WON.

The Hernandez family is in the fight of their lives right now. Closing remarks have been given, and the jury has entered deliberation. Every second feels like an eternity as they wait—hoping, praying, begging for justice.
