⚖️ Compliance with Federal, State, and Local Laws & Licensure
It’s not enough to meet federal rules—42 CFR § 491.4 requires clinics and staff to comply with all applicable federal, state, and local laws. That means state licensure, clinic licenses, staff certifications, registrations, etc. must all be in good standing.

✅ Action item: Do a legal/licensure audit: are all staff licenses up-to-date? Are clinic permits or certifications current? Are you aware of any new state/local rules that might affect your operations?

🌪 Emergency Preparedness: “All Hazards” Plan Needed
The regulations (§ 491.12) require RHCs to have an emergency preparedness plan addressing all hazards, not just medical emergencies—think natural disasters, supply failures, communication breakdowns, etc. Training and testing are required.

🚨 URGENT TELEHEALTH UPDATE 🚨
Due to the government shutdown, there is currently no extension for distant site medical telehealth services (per the CMS MLN Newsletter).

👉 Beginning October 1, 2025, unless Congress takes action, many of the pre-COVID restrictions on Medicare telehealth will return for services outside of behavioral and mental health.

⚠️ Key impacts:

No coverage for most telehealth visits provided in a patient’s home or outside of rural areas

Hospice recertifications will once again require in-person face-to-face visits

Some restrictions may affect a patient’s continued eligibility for other Medicare benefits

Practitioners may need to consider issuing Advance Beneficiary Notices of Noncoverage (ABNs) if providing services not payable by Medicare

Healthcare providers are encouraged to monitor Congressional action closely and consider holding telehealth claims that may not be payable after October 1.

RHCs must have a physician available for medical direction, AND non-physician practitioners (NP/PA/CNM) must be employed or under contract. Many states also require that NP/PA/CNM staff cover at least 50% of clinic operating hours.

✅ Action item: Review your staffing schedule to make sure the percentages are met, credentials/licenses are valid and displayed/in records, and oversight documentation is in order.
