🚨URGENT: ​Stop HB 744 from Redefining Holistic Care as "Unlicensed Medicine"🚨

​Ohio House Bill 744 is moving through the House Local Government Committee. While the bill aims to regulate massage establishments, its overly broad definition of "massage therapy" threatens to turn doulas, energy workers, and holistic practitioners into "unlicensed medical providers" overnight.

​The Problem: The "Touch Trap"

​As currently written, HB 744 defines massage therapy as any application of touch, pressure, stroking, or vibration intended to treat the human body. This definition is so wide that it inadvertently captures:

---> ​Birth Workers: Doulas and midwives using hip squeezes, counter-pressure, or effleurage for labor comfort.

---> ​Energy Practitioners: Craniosacral and Polarity therapists who use light touch to balance the nervous system without manipulating muscle tissue.

---> ​Lactation Specialists: Providers who use gentle touch to assist with breastfeeding and infant care.

​The Consequences

​If HB 744 passes without explicit exemptions for non-manipulative energy work and birth support:

---> ​Fines & Cease-and-Desist Orders:
Practitioners could face legal action for simply doing their jobs without a State Medical Board massage license.
---> ​Censorship:
Using words like "therapy," "treatment," or "bodywork" in your marketing could be labeled "illegal advertising."
---> ​Loss of Access:
Low-income families and birthing people will lose access to essential holistic support systems.

​Message: I am writing to express my concern regarding the broad language in HB 744. As written, the definition of "massage therapy" unintentionally criminalizes the work of doulas, craniosacral therapists, and polarity practitioners who do not practice soft-tissue manipulation. Please amend Section 4731.15 to explicitly exempt non-manipulative energy workers and birth support professionals. We must protect Ohioans' right to choose holistic care.

Ohio SB385 would create a new license for "naturopathic physicians" under the State Medical Board severely restricting your ability to practice or have access to natural health providers.

Traditional practitioners get no grandfathering.

Risks: Using titles like “naturopath,” “ND,” or describing services as naturopathic → illegal.

Offering individualized herb, supplement, nutrition, or wellness protocols → could be seen as unlicensed practice of naturopathic medicine.

Penalties: Felony (5th degree first offense, 4th degree after).

The bill is early-stage (just referred to Senate Health Committee). Contact your legislators if you want to protect access to traditional natural health!

It has been a while since we have made a call to action. The time has come for each and every provider or consumer of natural health to stand up and speak up.

**Your access to natural health is at risk in Ohio**

What Ohio SB385 does:

Only individuals who meet strict criteria (doctoral degree from an accredited naturopathic medical college, passage of a national licensing exam, criminal background check, good moral character, etc.) can obtain a license to practice naturopathic medicine or use protected titles.

No one may represent themselves as a “naturopathic physician,” “naturopathic doctor,” “naturopath,” “doctor of naturopathic medicine,” “ND,” or “practitioner or provider of naturopathic medicine” without the new license.

Broad scope of what counts as naturopathic medicine (Sec. 4789.09): Includes ordering labs/imaging, administering or prescribing (non-prescription) botanicals, vitamins, nutraceuticals, homeopathics, dietary supplements, hydrotherapy, physical medicine, therapeutic exercise, health education, minor laceration repair, foreign-body removal, etc., via various routes (oral, IV, etc.). Licensed NDs are explicitly barred from prescribing drugs, performing most surgery, or claiming to practice as any other licensed profession.

SB 385, as introduced, would significantly affect a traditional naturopath in Ohio, meaning someone who practices naturopathy using natural methods (herbs, nutrition, homeopathy, lifestyle counseling, hydrotherapy, etc., and holds diplomas and degrees from non-medically accredited schools and have certifications from boards such as the American Natural Wellness Practitioners Board.

The broad definition of "naturopathic medicine" encompasses the core activities traditional naturopaths do, using natural substances (botanicals, vitamins, minerals, homeopathics, enzymes, dietary supplements), therapeutic exercise, health education/counseling, using diagnostic tests (labs, imaging) in some contexts, and more. The bill frames these as part of a licensed system focused on diagnosis, prevention, and treatment via natural means.

If you currently call yourself a "naturopath" or market services as "naturopathic," that would become illegal under the title protection, even if you avoid full diagnosis/treatment claims.
**** If your services closely mirror the bill's listed modalities (especially if involving client-specific "treatment" plans for health issues), it risks being interpreted as prohibited unlicensed practice.

Penalties for knowingly practicing or using protected titles without the license.
***First offense - Felony of the fifth degree.
***Subsequent offenses: Felony of the fourth degree.
