Grid Rules

Social Security Administration (SSA) evaluates disability claims using rules that enable SSA employees to evaluate claims in a uniform manner. Most SSA's rules pertain to the evaluation of medical information. However, SSA also utilizes lesser known rules called the Medical-Vocational guidelines, commonly referred to as "grid rules" because the rules are presented in a grid layout. SSA employee use the grid rules to determine whether a claimant is disabled based on a combination of their age, education, and past relevant work experience. By SSA's definition, if you are 18-49 years old, you are considered to be a "younger individual". If you are 50-54 years old, you are considered to "closely approaching advanced age". If you are 55 or older you are considered to be of "advanced age". Under the grid rules, the older you are , the harder it is to adjust to new work, and the more likely it is, therefore, that you will be found to be disabled.

After you receive your Social Security Disability Benefits your case will be reviewed from time to time by the Social Security Administration (SSA) so that they can be updated on your medical condition and treatment. They will schedule a telephone conference with you, do not ignore them, they will discontinue your benefits for your failure to cooperate with them.

If you have not worked 5 years out of the last 10 years at the time you first became disabled you probably are not going to qualify for Social Security Disability Benefits (SSDI); however, you may qualify for Supplement Security Income (SSI) which is a needs based program. To get SSI you must: be age 65 or older, be totally or partially blind; or have a medical condition that keeps you from working and is expected to last at least one year or result in death. The basic monthly SSI payment for 2014 is the same nationwide. it is $721.00 for one person; or $1082.00 for a couple. You may be able to SSI if your resources are worth no more than $2000.00 for a person or $3000.00 for a couple. The Social Security Administration does not count your home you own and live in, or your car. They do count cash, bank account, stocks and bonds.

If you have been approved Social Security Disability Benefits (SSDI) you will receive Medicare two years from the date of your entitled to SSDI. If you were approved for Supplement Security Income (SSI) you will be entitled to Medicaid six months from the date of your entitlement to SSI.

Once the your application has been filed the Social Security Administration will have a medical consultant complete an Assessment of Residual Functional Capacity(RFC) to determine what you can still do despite your medical conditions. Before you file your Social Security Disability Claim on-line with the Social Security Administration make sure you have the following information:

1. The names and addresses of all doctors and hospitals you have been to in the last 12 months.
2. The dates of treatments for all doctors and hospitals
3. A list of all medical tests and the dates of such test.
3. A list of medicines that your doctors have prescribed to you in the last 12 months.
4. A list of all employers you have worked for in the last 15 years.
5. A list of all your current medical conditions.
6. The date your disability began.
7. The date you last worked.

All Social Security Disability Insurance claims and Supplemental Security Income claims begin by filing an initial application. Once filed the application is forwarded to the Disability Determination Services to be reviewed and evaluated by a disability adjudicator and physician or psychologist. If the medical records Social Security has access to do not give them enough information, you may be asked to attend a "consultative exam". This exam may or may not be with a doctor you have seen in the past. The claimant will receive written notice from Social Security once the claim has been decided. If the claim is approved, the notice will show the amount of your benefits and when payment will begin. If it is denied , the notice will explain why. Never doubt that Social Security is more likely to deny a claim than to pay one. If the initial application is denied, the appeal must be filed within sixty (60) days or the claimant's right to appeal will be lost and the last decision Social Security made will become final. The Claimant will have to start over with file another application for benefits.
