Our lawyers, Lawrence David and Jeff Orenstein from the legal firm Consumer Law Group, did an excellent job today in refuting the Royal Victoria Hospital's appeal application of our authorization judgment for the class action. Justice Geneviève Marcotte, of the Quebec Court of Appeal, is expected to render a decision this Friday, November 7th, 2025.
The Royal Victoria Hospital used the court cases of Kastner and Morrow as precedent to argue that the hospital had "...no liability for alleged depatterning treatments administered to patients under Dr. Cameron during the class period..." (see page 2 #5:https://clg.org/pdf/8/3/0/2/Application-for-Permission-to-Appeal--Royal-Victoria-Hospital.pdf ). It was contended, among other arguments, that each victims' case should be handled separately from the institutions and that the Royal Victoria Hospital should not be included in the class action. Additionally, it was argued that re-litigation constituted an abuse of process.
While listening to the Royal Victoria Hospital's arguments, Justice Marcotte remarked that the defense had not introduced any new case information and that everything had previously been documented and written about.
Since McGill University and the Attorney General of Canada have not attempted to contest the authorization judgment and the appeal application time has passed, the class action will move forward against them once the Royal Victoria Hospital's appeal has been resolved.
