I just put a comment on this page. It was immediately removed and blocked. As nurses and PA’s, we need to take a stance about this type of training. It’s my personal opinion this will lead to more complications thus giving our industry a black eye.

The Texas bill requiring in-person supervision of RNs and a bunch of other things isn't going away. If your Texas business is affected by it, I would suggest emailing the 2 sponsors of the bill (there used to be 1 sponsor, now there are 2). If this bill passes in Texas, other states will follow.

If this bill passes in Texas:

1. All Texas aesthetics businesses, including medical spas, IV hydration companies, wellness clinics, etc. will need an NP, PA, or MD on site;

2. Medical directors will be required to be within 75 miles of your business;

3. The number of NPs and PAs one MD can supervise will be lowered from 7 to 5; and

4. 10% of all charts will need to be reviewed by an MD.

With the many technological advances in medicine and communications, on-site supervision of registered nurses is unnecessary and allows for better access to care for patients. There is a nationwide shortage of doctors and other medical and nursing professionals. If this bill passes, it will further exacerbate this shortage and reduce patient care access. Texas has 206 locations designated as "medically underserved areas," ranking it second in the nation. There are 440 "health professional shortage areas" in Texas, affecting nearly 7.5 million Texans.

This bill is terrible for the people of Texas, bad for the Texas healthcare system, and bad for the Texas economy.

Attention Texas! We must be aware of the three proposed legislative bills (laws) that could be devastating to every area of nursing, including anyone who practices aesthetics under a plastic surgeon or dermatologist, this could possibly affect their ability to delegate.

Attention all aesthetic nurses in Texas. It is happening again. There are three House Bills with matching Senate bills directed at destroying our industry. I encourage all to research these bills. Get involved, get your clients involved, and write your congressman. Listed below are the bills. You will be out of business starting September 1, 2023, if these pass.

WAKE UP NEW JERSEY. Guidelines for Medical Spas in New Jersey

These are merely guidelines and represent a legal opinion. It is advisable to consult with an attorney as well as your malpractice carrier to ensure you are compliant with all the regulations. Nothing in this blog is meant to constitute legal advice.

Given the rapid growth of the medical spa industry, there is tremendous variation from state to state about the requirements for a medical spa in terms of ownership as well as who can perform the procedures. In addition, different boards within the same state may have conflicting or differing guidelines. For example, a board of nursing may allow a nurse to perform a procedure under the supervision of a physician however the board of medicine may not allow a physician to delegate certain procedures. If there is a poor outcome, then the supervising physician will be held to the more stringent guidelines of his/her own board even if the nurse performed the procedure.

In New Jersey, only a physician or physician group can own a medical spa. There may be certain workarounds to this such as a MSO or medical service organization which can only help with operations and administration and should have no bearing on the medical treatment.

The most important aspect is who can perform procedures in a medical spa. In New Jersey, In terms of laser-based services, a physician can delegate certain procedures like laser hair removal, infrared devices ( this can include YAG and nonablative erbium devices) and IPL to a physician assistant or a nurse.

A physician cannot delegate the use of radiofrequency to anyone. This applies to all radiofrequency devices including RF microneedling.

In terms of ablative treatments, such as a CO2 laser or ablative erbium laser, only a physician should be performing these treatments.

The NJ BOME proposed regulations prohibit a physician from delegating the performance of fillers or neuromuscular blockers to anyone. Proposed regulation N.J.A.C. 13:35-6.14B. This certainly is not followed in New Jersey where many of these procedures are performed by physicians assistants and nurses (nurse practitioners)

The physician can only delegate the task to a PA or RN after the physician has personally examined the patient. Thereafter, the physician does not have to be physically on site during the procedure, but will have to be in communication via phone or email. Coolsculpting would be included in this category.

I am a RN, BSN I worked for a plastic surgeon for 10 years, I have had my med spa for 15 years. I owned and provided home health for 25 years. Out in the middle of nowhere trying to do numerous thing that take alot more skill than doing an ablative laser or botox injection. I was there because no MD was going to go out and assess that problem. Your standing order was eval and treat. Call me in the morning. This is about money and control of money. Nothing more. If it wasn't for nurses in this industry, this industry would not be where it is today. We have nutured this industry from the beginning. MD did not want to be bothered with it. Now that we have master the tools, know how to comunnicate with the clients and understand their needs, they want to step in and take control. BS. I have great respect for my medical director and depend on his knowledge to give me direction. But the is a hostile take over of our industry. If we do not stand up and fight, you can kiss it goodbye. Unlike rule at TMB which can be changed , law becomes law and changing that is very difficult. Remember Texas only has a legislative session every 2 years. Nurses we need to unite and hold Amspas feet to the fire. I listened to Alex last night, now I want to see everything he said in writing. Because what he said and the paper I saw doen't jieve. Give to Texas Aestetic Nurses Coalition to save your scope of practise and business.
