Many families assume a Power of Attorney will cover every situation as a parent ages, but that isn’t always true. A POA only works if the person granting it still has the mental capacity to understand what they’re signing. Once capacity is lost, a POA can’t be created or updated.

Summer possession in Texas works differently than the rest of the year, and many parents don’t realize how early they must act to protect their time. Under the Standard Possession Order, the non‑primary parent gets extended summer possession — but only if they give written notice by April 1. If no notice is given, the default dates apply automatically.

The primary parent also has the right to designate one or two weekends during the other parent’s extended summer time, but they must follow the notice rules as well.
