In the United States, the word “chocolate” is regulated by law, but many products on store shelves avoid those standards by using slightly different wording on the label.

Knowing the difference can help you understand what you’re really eating.

What legally qualifies as chocolate in the U.S.:

According to standards regulated by the U.S. Food and Drug Administration:

• Milk chocolate must contain at least 10% chocolate liquor (cocoa solids)
• Sweet chocolate must contain at least 15% chocolate liquor
• White chocolate must contain at least 20% cocoa butter

Chocolate liquor is the paste made from ground cacao beans, containing both cocoa solids and cocoa butter.

If a product does not meet these standards, it cannot legally be labeled as chocolate.

Instead, companies often use phrases such as:

• chocolate-flavored coating
• cocoa-flavored coating
• chocolate-flavored candy

These products are often made with sugar, palm oil, vegetable oils, and small amounts of cocoa powder, rather than real cocoa ingredients.

What about dark chocolate?

Interestingly, “dark chocolate” is not a legally defined category in U.S. regulations.

White chocolate is different too.
