The PUMP Act stands for the Providing Urgent Maternal Protections for Nursing Mothers Act. It’s a U.S. federal law that expands protections for employees who need to express breast milk at work. The law was signed in December 2022 and went into full effect in April 2023.
Here’s what the PUMP Act does:
1. Expands coverage:
It extends the right to reasonable break time and a private space for pumping breast milk to nearly all employees, including salaried workers, who were not covered under the original 2010 Break Time for Nursing Mothers law (part of the Fair Labor Standards Act, or FLSA).
2. Break time requirement:
Employers must provide reasonable break time for an employee to express breast milk each time it’s needed for up to one year after childbirth.
3. Private space requirement:
Employers must provide a private, non-bathroom space that is shielded from view and free from intrusion for expressing milk.
4. Protection from retaliation:
The law makes it illegal for an employer to retaliate against an employee for asking for or using these rights.
5. Remedies and enforcement:
Employees can now file a lawsuit against an employer that violates the law, even without first filing a complaint with the Department of Labor.
