New legalization will soon increase New Mexican’s access to psilocybin for therapeutic use in the treatment of death anxiety and depression for those with advanced and terminal illness. This effort has included a number of lawsuits in federal court raising issues as to the application of Right to Try laws and has included a Petition to reschedule psilocybin from Schedule I to Schedule II. In February 2025, this petition will likely be transmitted to HHS and FDA for evaluation and a scheduling recommendation. We will hear from Seattle palliative care physician Dr. Sunil Aggarwal, the petitioner.

Right to Try laws, which (in theory), provide patients with a life-threatening conditions a shortcut to access “investigational treatment options.” Recognizing that such patients do not have the luxury of time to await the slow process of new drug approval. Many veterans, children with rare diseases, and elderly people with terminal illness will benefit from this rescheduling. This finding will significantly impact the way psilocybin is used. Early next year, medical psilocybin should be legally prescribe-able and dispensed for legitimate medical purposes and will ease access for research purposes. We will discuss this and other emergent issues in the psychedelic landscape with New Mexican palliative care physicians and death doulas, including Dr. Van Warren, Dr. Sunil Aggarwal, Danielle Slupesky, and Dr. Lida Fatemi.

New Mexico has a growing death doula community, along with palliative care with psilocybin, are new specializations attending to patients with existential and spiritual distress or pain. We thought it was important to discuss updates on therapeutic advancements in psilocybin’s application including the Right to Try Act and access to ceremonial models of psilocybin administration.

The Medical Psilocybin Act—Senate Bill 219 was submitted last night in the New Mexico Legislature! This bill could shape New Mexico’s medical psilocybin framework.
Senators from both parties are supporting medical psilocybin mushroom program to address the mental health crisis.
Sponsors of Senate Bill 219 include Senator Jeff Steinborn, D-Las Cruces and Rep. Andrea Romero, D-Santa Fe. The program would make access available by Dec. 31, 2027, under which people could receive psilocybin treatment for ailments including major depression, post-traumatic stress and substance use disorders, end-of-life care and other conditions approved by the state Department of Health.
“Psilocybin research is revolutionizing mental health care, offering hope to patients battling depression, PTSD, and anxiety," Romero said in a statement. "With this legislation, New Mexico is leading the charge in treatment innovation, setting a powerful precedent for compassionate and science-backed care.”
