I really thought I could stomach working 2 hours/day in this industry without running into the wage/hour, production pay nonsense. But apparently not. Getting scolded by my employer for working outside of my scheduled hours - while she compares my actual time logged into the transcription module and finds that is 19 minutes more than my timesheet. Yes, you heard that right. What if a job goes over, I ask her? We should estimate better and log off and then just do some other things for the remainder of the time. WHAT? I don't get paid to putz around in this ridiculous environment, and you don’t get to control me when I’m not getting paid. Why is that rocket science to all of these companies? I provide her with several examples of why this doesn’t work, but what in the hell is the problem with all these companies that blatantly ignore these laws? I'm so angry over it, I could scream. We don't just TRANSCRIBE, people. We are doing other things. We log on, log off, our voice file crashes, we go to the bathroom (funny, my real job pays me to do this), windows updates in the middle of work, we answer emails, we read your nagging emails, we purchase our new InstantText subscription, you run out of work after we secure our day for you, we are entitled to 20 minutes PAID breaks (yes, they are required to PAY you for them) per day that you ignore, we take a bloody one hour PayCom inservice that you, manager, gets paid to do but I don't. We record our time, and the list goes on. We buy our own bloody equipment and pay for our own frigging internet service, software, desk, foot pedal and more; and you want to threaten termination to us because our time is not exact to the frigging minute while we nicely work for you for nothing. You’ve got to be kidding me.. We can’t document it accurately because you pay us illegally and we never know how to acknowledge or deal with all THAT time. I launched into orbit at her and sent her 6 links about piece-rate violations. Also, California now stating that managers can be held personally liable for supporting wage/hour abuse for their employer.
Looks like California is finally cracking down on the abuse of piece rate laws. Hopefully it is enforceable. And NO, you can't just turn everyone into a contractor to get out of it or groom the thing to look cute enough to pass that test.
How do these people lay their heads down at night or do they just think it is fine enough to ignore these laws and rip us off? Then scold us for not playing their dirty game? So sick of it.
