Never a dull moment in this sector… we wait with bated breath!

The Senate Order of Business indicates that NDIS Minister, Senator McAllister will introduce the National Disability Insurance Scheme Amendment (Integrity and Safeguarding) Bill 2025 this afternoon.

The Bill seeks to strengthen the NDIS Commission’s compliance and enforcement powers and introduce new statutory duties for providers and key personnel. It also aims to expand the scope of regulatory oversight through measures such as stronger penalties, anti-promotion orders and tighter information-gathering powers.

It was signalled that an exposure draft would be released first, however today’s introduction suggests the Government is moving ahead sooner than expected. These proposed reforms recently went out for consultation so we will be watching closely to see whether stakeholder feedback has shaped any changes to the final version.

Good morning! Another update to the NDIS Pricing Arrangements and Price Limits comes into effect today.

See the revised version (with changes listed on Page 2) HERE:

Notable edits are:
- New price cap per hour of $156.16 for Art and Music Therapies
- Definition for 'Other Professional' - use of this code needs to be endorsed by the NDIS Commission (page95) "...have been accepted by an approved quality auditor of the NDIS Commission as having the relevant qualifications"
- Definitions have tightened for use of codes:
>04_210_0125_6_1 (Community, Social, and Recreational Activities)
>09_008_0116_6_3 (Innovative Community Participation)
>09_011_0125_6_3 (Community Participation Activities)
- Removal of the Low Cost AT code in Capacity Building
- Definition for Intensive (High Intensity) and Complex Behaviour - providers must be compliant with Module 2A (and behavioural support practitioner must be registered) even if the funding is plan managed.
- Further clarity around travel costs for therapists

A timely reminder that the agency no longer has any tolerance for providers charging gap fees. Plan Managers are now instructed to report all suspected breaches to the NDIS Commission. Further info here: https://www.ndis.gov.au/news/10827-travel-claiming-rules-gap-fees-and-other-costs

Compliance with changes continues to be a high priority for us all. The Agency and the Commission are very serious about the issue of Payment Integrity Audits to ensure providers are accountable for their billing and service delivery.
