💡Psychological injury claims are rising faster than ever in Australia – and the cost to Australian workplaces is too big to ignore.

New Safe Work Australia data shows serious mental health claims are up 14.7% in one year, now the highest proportion ever recorded. Workers with psychological injuries are off work nearly 5x longer than those with physical injuries. The median compensation is also 4x higher than other physical injuries.

This 𝐖𝐨𝐫𝐥𝐝 𝐌𝐞𝐧𝐭𝐚𝐥 𝐇𝐞𝐚𝐥𝐭𝐡 𝐃𝐚𝐲 (Friday 10th October) is a reminder that protecting mental health at work isn’t just a personal responsibility, it’s a collective one and most importantly it is an employer’s legal obligation — every day of the year!

A mentally healthy workplace takes positive steps to prevent harm by identifying, eliminating and managing mental health hazards, in consultation with workers. It is also about assisting workers and supporting their recovery, just like we would with physical hazards at work. Under the WHS Act (or the OHS Act in Victoria), employers must provide and maintain a working environment for their people that is safe and without risks to mental health.

Across Australia, union advocacy has led the charge to make mental health a workplace priority. From addressing psychosocial hazards and excessive workload to securing stronger laws and consultation rights, collective action is reshaping how employers protect psychological wellbeing at work. These efforts have already led to major changes that are improving mental health outcomes for workers across the country.

Did you see the news? New Occupational Health & Safety Regulations (Psychological Health) will come into effect in Victoria from December 1.

These rules recognise that psychosocial hazards — such as bullying, harassment, aggression, or exposure to traumatic content — are as significant as physical hazards, aligning Victoria with other states in raising the bar for psychosocial safety.

Why this matters:

✔️Employers will now have clearer obligations to manage mental health risks at work
✔️Workers should benefit from safer environments and stronger legal protections
✔️It sets a precedent for recognising psychological health as integral to workplace safety

For workplaces across Australia — not just Victoria — it's a timely reminder: mental health hazards must be treated with the same seriousness as physical ones.

📣 From 26 August 2025, employees in small businesses (fewer than 15 staff) have a right not to answer work calls, emails, or messages outside your hours—unless it’s reasonable or urgent.

💡This is a big step for workplace mental health and work–life balance, giving workers in small businesses the same right as those in larger businesses. But it also means employers and employees need open conversations about how to navigate these new laws within the unique business and operational needs of a small business.

According to the People at Work Survey, workers in the health care and social assistance industry are much more likely to experience workplace violence, particularly angry or hostile behaviour (50%, compared to 41% across all industries).

Frontline workers deserve better workplace mental health, which is why we’re glad to see the industry’s new code of practice launched this month. The Code guides duty-holders on how to manage risks in the workplace and meet workers’ health and safety needs.

💡Mental health claims among the nursing, care and support workforce have almost doubled in the last 10 years. The majority of claims (8 out of 10) are reactions to workplace stressors and post-traumatic stress disorder.

📄This month, Safe Work Australia published the industry’s new code of practice, created to help employers better meet their workplace health and safety duties, including protecting workers’ mental wellbeing.

We’re taking action to protect workplace mental health

Work is a significant factor in people’s mental health. We know that meaningful, rewarding, good work can impact positively on our mental health. Equally we know that issues such as high workloads, customer and client aggression and poor workplace relationships can adversely impact on workers’ mental health.

This campaign is about recognising the impact that the workplace itself has on workers’ mental health. Mind Your Head encourages action in workplaces to address mental health hazards – just like we would take action on a slip hazard.

THE PROBLEM

Just like physical health and safety hazards, such as slippery surfaces, dangerous and unguarded machinery and badly set-up work stations, there are also workplace mental health hazards, like high workloads, isolated work and poor role clarity.
