Avoiding conflict between parents is crucial for the well-being of children. Utilise digital technology to facilitate smooth communication and coordination. Ideally, shared care parenting works like this:
-Each parent provides a stable and nurturing home environment.
-Changeovers occur amicably between parents or via care providers.
-Timetables are followed consistently unless both parties agree to changes.
-Communication remains focused on the child's well-being and is free from conflict.

By prioritising cooperation and open communication, parents can create a harmonious environment for their children's growth and happiness.

Q: Is mediation mandatory for family law disputes, or is it optional?

In family law disputes, mediation is now part of the pre-action requirements in the Family Court. There are some exceptions to this requirement. Parties need to make a genuine attempt to resolve their dispute during the mediation process otherwise their non-compliance can be reported to the court. Participation is always voluntary and parties cannot be forced to resolve their dispute at mediation.

Consulting a family lawyer or mediator in your area can help you understand the rules and the options available for resolving your case.

What are the non-financial contributions that are considered in the assets and liabilities division?

Non-financial contributions are taken into consideration during property settlement proceedings. They include parenting and homemaker contributions and other non-financial contributions like providing personal unpaid labour in maintaining or improving the assets or liabilities or the care of a party to the relationship. Non-financial contributions are relevant to the determination of a fair and equitable division of the assets and liabilities between the parties involved.

A: Yes. You can apply for a parenting order in relation to a child, even if you are not a parent of the child, if you are a grandparent of the child, or you are a person concerned with the care, welfare and development of the child.

FAQ: What happens after dispute resolution?

When an agreement is reached at court-based dispute resolution, the judicial registrar conducting the conference will make interim or final orders reflecting the agreement. Those orders take effect immediately.

When agreement is reached at private or community-based dispute resolution, you and the other party/ies can file consent orders with the Court or discontinue the Court proceedings and enter into a parenting plan. This will bring your court action to an end.
