The Federal Court has imposed the largest penalty ever on a Tasmanian NDIS provider for serious safety and reporting failures.

Registered NDIS provider Oak Tasmania has been ordered to pay $1.1 million following proceedings brought by the NDIS Commission, concerning multiple incidents that put participants at risk.

The Court found care plans weren’t followed, staff were inadequately trained, medical care was mismanaged, and an adolescent was not properly supervised. It also found that hundreds of serious incidents weren’t reported within required timeframes, limiting the NDIS Commission’s ability to keep participants safe.

People with disability have the right to safe and competent supports and services, and timely protection from harm. When providers fail to meet their safety and reporting obligations, the NDIS Commission will take strong enforcement action to hold them to account.

NDIS providers implementing behaviour support plans with regulated restrictive practices are required to report monthly.

Reports must be submitted via the Behaviour Support portal by the 5th business day of each month, even where no restrictive practices were used.

Reporting shows the NDIS Commission how and when restrictive practices are used so we can identify risks, follow up where needed, and reduce unnecessary reliance on these practices over time.
