Consultation Opportunity: WHS Dispute Resolution

Safe Work Australia is seeking consultation input on possible improvements to dispute resolution processes within the model Work Health and Safety (WHS) laws.

The current framework can leave certain workplace safety disputes unresolved, which may create ongoing challenges for those involved. The consultation is exploring options that could strengthen the process, including the potential use of a specialist tribunal and other alternative dispute resolution mechanisms.

Feedback gathered during this process will assist in developing recommendations for consideration.

Who may wish to contribute?
Safe Work Australia is inviting feedback from a wide range of stakeholders, including employers, workers, regulators, members of the public, government bodies, unions, legal practitioners, researchers and other interested parties.

CROSS APAC and CROSS Recruit recently attended the Solace Advisory and Results Legal Seminar in Rockhampton and it was a fantastic opportunity for both professional development and local connection.

The event featured two dynamic sessions designed to deliver practical insights and fresh perspectives with key considerations around contractual law and wealth distribution and succession planning in multi-generational family businesses, providing valuable knowledge with real-world relevance for businesses and professionals alike.

The way work is managed is evolving and now WHS is evolving with it.

On 12 February 2026, the Work Health and Safety Amendment (Digital Work Systems) Bill 2025 (NSW) was passed by the NSW Parliament, making New South Wales the first Australian jurisdiction to specifically address the health and safety risks created by digital work systems.

This legislation recognises that technology is no longer just a business tool. If a system influences how work is allocated, monitored, measured or performed, it is now clearly part of a PCBU’s WHS responsibilities.

Digital work systems may include:
✅Artificial intelligence and algorithms
✅Automated rostering or task allocation
✅Productivity and performance monitoring tools
✅GPS tracking, surveillance or workforce management platforms

PCBUs must ensure, so far as reasonably practicable, that these systems do not create risks to health and safety, including:
🔶Excessive workloads or unrealistic performance expectations
🔶Fatigue and psychosocial hazards
🔶High-pressure or intrusive monitoring
🔶Unintended bias or harmful outcomes from automated decision-making

The amendments also allow WHS entry permit holders to request reasonable access to digital work systems when investigating a suspected WHS concern. Entry permits are issued under the WHS framework and are not limited to union representatives.

📌Good work design reviews

We had a wonderful morning representing CROSS APAC and CROSS Recruit at the Breakfast of Champions Business Connect event hosted by the Aligra Group

It was a great opportunity to step away from the desk and connect with other businesses across the region, share insights, and strengthen relationships with key players across business and local leadership. Events like these are a great reminder of the strength, collaboration, and opportunity that exists within the Central Queensland business community.

We also heard an insightful presentation from NBN Australia, the Event Partner and featured guest, who shared valuable perspectives on regional connectivity and what it means for local business productivity, resilience, and future growth.

Pre-employment medicals: Getting the balance right

Pre-employment medicals can be a valuable WHS tool when they are used for the right purpose. Their role is simple: to confirm whether a candidate can safely perform the inherent requirements of the job and to help prevent injury or aggravation risks.

To keep the process compliant and defensible, employers should focus on a few key principles:

✅Keep it job-specific:
Assess only what is relevant to the physical or functional demands of the role.

✅Assess capacity, not medical history:
The question is whether the person can perform the work safely, not the details of their medical history.

✅Consider reasonable adjustments:
Where a health condition is identified, explore practical adjustments that may enable safe work.

✅Protect privacy:
Health information is sensitive and should be collected with consent, limited to what is necessary, and securely managed.

When aligned to role requirements and supported by clear decision-making, pre-employment medicals strengthen both safety outcomes and legal protection.

January 2026 Update: HSR Guidance for Asbestos Management

Safe Work Australia has released updated guidance clarifying how existing Health and Safety Representative (HSR) powers apply when asbestos risks are identified or suspected in the workplace.

The January 2026 update does not change legislation. Instead, it reinforces current obligations and provides practical guidance to support effective consultation and timely action where exposure concerns arise.

The updated guidance highlights that, under existing WHS laws, HSRs may:
• Raise concerns about potential asbestos exposure
• Request information about asbestos risks and controls
• Seek a review of control measures, including air monitoring where appropriate
• Support consultation between workers and the Person Conducting a Business or
Undertaking (PCBU)

What this means for businesses

This update is a timely reminder to ensure your asbestos management processes are current and well understood:

• Review and maintain your Asbestos Management Plan
• Confirm your asbestos register is accurate and accessible
• Strengthen consultation processes with workers and HSRs
• Ensure supervisors know how to respond to HSR requests or concerns
• Document actions and decisions where asbestos risks are raised

While the legal powers remain unchanged, the expectation around early response, clear communication, and effective risk management continues to be a key focus.

A new Model Code of Practice: Elevating Work Platforms has just been published by Safe Work Australia.

Elevating work platforms (EWPs), including boom lifts, scissor lifts and similar mobile plant, are widely used across many industries, but they remain a high source of risk if not managed correctly. The updated model Code brings together practical guidance on how to safely manage those risks under the Work Health and Safety framework.

This model Code replaces two previous guides and provides clear guidance on:
• identifying and assessing common risks associated with EWP use
• implementing effective control measures to eliminate or minimise those risks
• inspection, maintenance and proper use of EWPs as part of a proactive risk management approach.

It’s a timely reminder that managing plant and equipment safely requires a structured approach to risk, including selection of the right equipment for the conditions, ensuring operators are trained and competent, and maintaining equipment to the standard expected under the WHS laws.

For PCBUs and duty holders, this model Code is a practical reference that supports compliance with health and safety obligations and helps build safer worksites.

If you’re working with EWPs or responsible for a workplace where they are being operated, it’s worth taking the time to download and familiarise yourself with the new model Code.
