For , we look at what that actually means.

The Pre-Action Protocol is a set of steps that you and the healthcare provider must follow before a claim reaches court. It’s designed to:
🔹 Set out your concerns clearly
🔹 Allow the hospital or clinic to investigate
🔹 Encourage early communication
🔹 Help both sides understand the issues and, where possible, reach a resolution without going to court

This process usually involves gathering medical records, obtaining expert evidence, and sending a formal Letter of Claim explaining what went wrong and how it affected you.

If, after these have been issued, no settlement has been reached, then court action will follow.

No amount of money can bring back a loved one who has died from medical negligence. But many assume the loss of life will warrant the highest amounts of compensation, when in reality that is not the case.

The statutory amount for bereavement damages is £15,120.

Even then, only certain family members can claim this in England and Wales, excluding parents of unmarried adult children, grandparents, siblings, and other people who might have been dependent on the deceased.

Bereavement damages in particular have long been highly criticised for being out of date, rigid and discriminatory.

1st December means one thing - it’s advent calendar time! But this year our Sheffield team have generously been sent a Countdown to the Christmas Break box from Bush & Co.
It’s filled with a bundle of small surprises designed to brighten the days from 1st December to 19th December. What a fab idea to get us all in the festive mood.

We are proud to be supporting our brilliant client, Medical Solicitors, this Christmas as part of helping local charity, Santa Squad, achieve their mission. 🎄

Santa Squad is a fundraising group for Hull's children, started by Hull's children. By working closely with schools in Hull, who identify their neediest pupils that are at risk of not receiving anything for Christmas, the team then work with business partners and the local community to acquire the items that have been requested. 🎁

November seems to have been a busy month for networking!
Later today, Sarah and Miriam are heading down to London ahead of tomorrow's Action against Medical Accidents - AVMA specialist clinical negligence panel meeting.
This annual meeting allows panel members the chance to meet, network and discuss the latest key developments and issues facing clinical negligence law.
This year there will be discussions on maternity investigations, anonymity orders, and the impact of the Mazur ruling on litigation.
Then in the evening there's a fabulous festive get-together for the Holly Jolly Christmas event.

How would you feel if you were told you'd got cancer, had life-changing surgery to give you the best chance of being around for your family, then found afterwards it had all been unnecessary?

That's what happened to our client, Erica.
She underwent a partial lung removal for a suspected diagnosis of lung cancer.
However, two weeks after the procedure, she was then told her symptoms had been caused by pneumonia.

After the misdiagnosis came to light, Erica turned to our solicitor, Miriam Bi, to investigate how this had happened.
