What if someone does not have the capacity to appoint an attorney under an ?

If a person lacks the to create a Lasting Power of Attorney (LPA), they can no longer appoint someone to act on their behalf. In this case, an application must be made to the to appoint a deputy authorised to make decisions on their behalf.
While there are both cost implications and benefits to setting up a deputyship, it is often advised to set up an LPA early, while the person still has capacity.

🧠 Under the 2005, capacity must be assessed at the exact time a decision is needed. If alcohol is involved, assessments may need to be delayed until the person is sober enough to participate meaningfully.
