AMENDMENTS FOR EASE OF BUSINEES IN HOMOEOPATHY DR.SUSHIL VATS Ministry of health and family welfare, Government of India has amended the Drugs and Cosmetics Rules, 1945 by the Gazette notification dated November 10, 2017. These rules will be referred as the Drugs and Cosmetics ( 11th Amendment) Rules,2017 and have come into force from 10th November 2017. Central government in consultation with the Drugs Technical Advisory Board decided to amend the rules and published the draft of same rules as required under section 12 and section 33 of the Drugs and Cosmetics Act 1940 in the Gazette of India extraordinary, part 2, section 3, sub-section (1) on 1st February 2017. DR.K.G.SAXENA: STALWART OF A DIFFERENT KIND
DR.SUSHIL VATS
History of Homeopathy in India is almost 200 hundred year old, we have had many stalwarts who did yeoman service to popularise homeopathy in the masses but among them contribution of Dr.K.G.Saxena stands out for getting homoeopathy its due in the eyes of the government of India. He was a stalwart of different kind; supreme in his personal resources & modest in his living. This writer has the wonderful privilege of knowing the great man personally as one of the organizer during the Golden Jubilee Congress of I.I.H.P held in New Delhi in the November 1995. In the mature age of eighty plus he would not hesitate to come for the meetings in Daryaganj, Central Delhi all the way from his South Delhi apartments. I asked him why do he comes down rather than calling us to meet him, he said why do ten people bother & waste time to come to me when I can drive down. I learned that honesty of work & modesty were core issues with him. He did not want an aura of achievements surrounding him, nor did he have that much sense of achievement about the entire struggle he did for homoeopathy. He termed this as his destiny and told me that he enjoyed his time as the torch bearer of homoeopathy in the most crucial time of its need.
Born on 25th September 1912 in New Delhi to a father who was interested in Homeopathy, Dr.K.G.Saxena did his graduation in Homeopathy from the Calcutta Homeopathic Medical College in 1937. Dr.Saxena has written in his book that although miraculous cures were achieved by Homeopathy and its top rankers were respected and adored in the society, the plight of an average Homeopathic practitioner was miserable and pathetic. The Allopathy had the best showmanship & was the fashion of the day. But the average homoeopathic practice was not lucrative and the practitioner was not a show boy. In this environment the homoeopathic colleges only attracted middle class family students who could not afford the costly Allopathic course but were still interested in being called a “doctor”. He further says that while Ayurveda & Unani had the backing of the tradition, religion & society, and Allopathy had the best showmanship and was the fashion of the day, homeopathy was new & unknown entity.
In Calcutta Dr.K.G.Saxena had Dr,B.K.Bose, Dr.G.N.Sinha, Dr.A.B.Malik, Dr.P.Saha, Dr.S.N.Ghosh, Dr.A.N.Mukherji & Dr.B.B.Mukherji as his teachers. During this period Dr.K.G.Saxena really understood the implication of non-recognition of the system by the government. He took it on him to work for the government recognition of homoeopathy as a challenge. He writes, “I accepted the challenge without any resources and any political God father, and took the pledge to devote my whole like to the cause of recognition and development of homeopathic system in India”.
India was engaged in its struggle for freedom from British Raj, and Dr.K.G.Saxena was starting his struggle for homoeopathy in India. He has written, “My struggle for development of Homeopathy started in earnest, I had no resources to fight this battle other than my devotion and zeal and my sincere conviction that this great scientific and potentially useful healing art could be utilized for the service of humanity”. He worked with objective to change the public perception about Homoeopathy & to rouse the interest of the Government in this method, in thought about garnering support of MLA to move a resolution in the Central Legislative Assembly which was the highest political body that time.
I t is hard to imagine that a young homoeopath only 24 years of age dared to meet MLAs of Central Legislative Assembly , who invariably ridiculed him, even showing him the door for wasting their time for something not worth talking in the assembly. But Dr.Saxena knew what he was aiming for , so he went about his task undeterred by the comments of many MLAs who did not know about homeopathy. His determination paid off & a resolution was tabled in the Central Assembly on 2nd October 1937 by Mr.Ghiasuddin, an MLA from Punjab. Dr.K.G.Saxens went to Parliament House to distribute pamphlet containing merits of homoeopathic system to all members of the Central Legislative Assembly.
Picture in the assembly was gloomy & hopeless as Congress party refused to support the resolution, they thought that homoeopathy was not a scientific system, but on lobbying by Dr.Saxena they agreed not to issue whip to the member of Congress Party so that members could vote for the resolution out of their will. As a result of these efforts the resolution was carried by a margin of 8 votes. Dr. Saexna writes, “That day saw the first and most important victory for the system. Since that day onwards and with the resolution adopted, the system could progress further even though it was at snail’s pace. As a result of this resolution we could ask the state governments to recognise homoeopathy & in 1943 Bengal govt. took up the cause of homoeopathy and constituted the first Faculty of Homeopathic medicine.”
Assembly resolution encouraged Dr.Saxena to strengthen the homoeopathic profession for future fight & in 1944 All India Institute of Homeopathy with central office in Delhi was formed. Dr.A.N.Mukherji of Calcutta, Dr.Dewan Jai Chand of Lahore, Dr.Daya Shankar Kayatha, Dr.J.P.Srivastva, Dr.S.P.Asthana & Dr.K.G.Saxens of Delhi were the founding members. Dr.K.G. Saxena was nominated founder General Secretary of this institute. However government of the day continued to be indifferent towards homoeopathy. Meanwhile India got its independence and it was felt that lobbying should be done to put up another resolution before parliament.
On 17th February 1948, within six months of our independence a resolution in support of homoeopathy was discussed for three hours & unanimously adopted as an official resolution of Parliament of India, thus peeving the way for government recognition for Homeopathy in India. Meanwhile a delegation of All India Institute of Homeopathy led by dr.K.G.Saxena met Health Minister Rajkumari Amrit Kaur & Dr.Jivraj Mehta, director general of health services, and health secretary govt of India. The officials agreed to adopt the parliament resolution as policy document but said the govt would implement the resolution only after an enquiry committee of Govt of India confirms that homoeopathy is a scientific system of medicine. On 30th September 1948 Health Minister RaJkumari Amrit Kaur announced the constitution & terms of reference of Homeopathic Enquire Committee.
IN 1949 HOMEOPATHIC ENQUIRE COMMITTEE REPORT WAS PUBLISED WHEREIN IT ACCEPTED THE SCIENTIFIC BASE OF HOMOEOPATHIC SYSTEM & RECOMMENDED TO THE GOVERNMENNT THAT HOMOEOPATHY BE RECOGNISED OFFICILALLY AS A SCIENTIFIC SYSTEM. The members of the enquire committee included Sh.J.N.Mukherjee as Chairman, Col[dr] Amar Chand of IMA, Dr.J.N.Majumdar, Dr.J.N.Hazra, Dr.L.D.Dhawale, Dr.Diwan Jai Chand, Dr.P.N.Chopra, Capt. K.V.Ramana Rao. Dr.S.C.Sen & Diwan Chand Chopra as Secretary. This had a very encouraging effect on the morale of the profession, and homeopaths working in different parts of India felt proud about this achievement.
Nothing much happening and govt sitting on the enquiry committee report, Dr.K.G.Saxena decided to pressurize the govt politically. He met many leaders of the congress party to lobby for the further action towards the recognition of homoeopathy. Health Minster Rajkumari Amrit Kaur in consultation with Dr.K.G.Saxena constituted an Ad Hoc Committee for Homeopathy in 1952. Ad Hoc committee held four meetings from 1952- 54 made strong recommendations for the development of homoeopathy. This resulted in the formation of first homoeopathy advisory committee in the year 1956.

This is a welcome move and we thank Prime minister to bring AYUSH under a Cabinet minister. This would speed up the growth of AYUSH SYSTEMS during this Pandemic time.
We hope new minister would recognise the role played by Homoeopathy in Covid 19 pandemic .
However onus is on Homeopathy Fraternity how best to use this for the growth of Homoeopathy in India.
With National Homeopathy Commission under chairmanship of sanguine Dr Anil Khurana let's hope deficiencies in Education area would be addressed to have colleges with better infrastructure and academics.

CCRH SCIENTIFIC CONVENTION

Central Council for research in Homeopathy organised a two days scientific convention to commemorate 264th birthday of Dr.Hahnemann as WORLS HONEOPATHY DAY, ON 9TH & 1OTH April 2019 at Dr.Ambedker International Centre ,New Delhi. Two days convention was titled as LINKING EDUCATION AND CLINICAL PRACTICE WITH RESEARCH: ADVANCING SCIENTIFIC COLLABORATIONS. Five hundred delegates from all over India and outside participated in this 2 days convention. Welcoming the delegates DG CCRH Dr.Manchanda said that our team of scientists has chosen this theme after much thought and brainstorming at what really is required to take homeopathy to next level, both nationally and internationally. We had consensus on the fact that if we are talking of progress, we have to talk of research. The researches that come out of research organisation have to spread and percolate to the level of practitioners and academicians, and even students. He said while the students and faculty need to be oriented for better research designs and identifying vital research questions in homeopathy, the practitioners need to be sensitised about the significance of the huge data they generate in their clinics, and how it can become evidence based and an acceptable collection for research.
Mr.Roshan Jaggi Joint Secretary AYUSH said Homeopathy system has become significant contributor in public health system of India and CCRH has been actively collaborating for research projects and international cooperation in the field of Homeopathy. This has attracted the attention of clinicians, researchers and professional from varied fields and valued collaborations among them have taken homeopathy to new heights. This has empowered the homeopaths to contribute in quality research and scientific validations. Ministry of AYUSH has also encourages international propagation of AYSUH by promotional activities, supporting international market development and participation in International events.
Mr.N.Sanyal IAS[ retd], Chairperson of Board of Governors, Central Council Of Homeopathy, said best way to celebrate this occasion of 264th Birth day of Dr.Hahnemann is to live up to his teachings and carry forward his mission. And same is being done through this event with the theme that bridges the three key aspects of Education, Clinical Practice and Research. He said there have been consistent efforts by the Council to inculcate a yeaning for research and requisite aptitude among students. The curriculum of both UG and PG homeopathic courses has been has been evolving lately, covering this aspect. This is quite essential to establish homeopathy on a firm footing by developing new frontiers of knowledge and establishing evidence in favour of tenets of this body of knowledge.
Viadya Rajesh Kotecha , Secretary AYUSH, said CCRH is providing an apt platform for researchers to show case their scientific work and encourage interaction among the clinicians, researchers, students and other people associated with Homeopathic industry. Councils involvements in various research activities is commendable, like fundamental and collaborative research, clinical research, drug development, epidemic research and surveys, which incorporate the latest technology abd best of the technical minds for the cause of Homeopathy.

1.Dr.Ramanlal Patel, LIFETIME ACHIEVEMENT AWARD 2019, He is a living legend of homeopathy, having experience of more than 50 years in treating cancer cases. Dr. Patel is a keen observer, a compassionate physician and a vociferous teacher, a survivor of cancer himself; he has dedicated his life to homeopathy. Dr. Patel is the Founding Director of Dr.R.P.Patel Institute of Homeopathy research and Education Baroda, he has worked on 50 Millesimal Scale Potency, discovered new system of treatment tautopathy, Autovisual Homeopathic repertory an invention patented in 1980.
2.Dr.Ravi M Nair, LIFETIME ACHIEVEMENT AWARD 2019, He has worked relentlessly for more than 55 years as a practitioner, educator, researcher and policy maker in Homeopathy. He was the architect of Kerala State Homeopathic Co-operative Pharmacy, Alappuzha. As a founder President of Institute of Homeopaths Kerala, Dr.Nair laid a road map for development of Homeopathy inn public health care delivery system in Kerala.
3.Dr.Laxmikanta Nanda, BEST TEACHER AWARD 2019, is an immensely promising and talented teacher with an extraordinary ability to translate the professional experience into practice. He has been in teaching for more than 40 years, having served as Principal cm Superintendent of Dr.Abhin Chandra Homeopathic Medical College & Hospital Bhubaneswar Odisha. He has also been M.D. guide for more than 30 M.D. students. Dr.Nanda has 91 publications in reputed national & international journals.
4. Dr.Poonam Hima Bindu, YOUNG SCIENTIST AWARD, is a young scientist working as Research Officer at Extension Clinical Research Unit, Princess Duru Shehvar Childrens’s and general Hospital Hyderbad.
5. Dr.Munmun Koley YOUNG SCIENTIST AWARD, has worked as Senior Research Fellow in the Central Council for Research in Homeopathy at its centers Siliguri and Kolkata.
6.Dr.Divya Taneja, YOUNG SCIENTIST AWARD, is a young scientist in homeopathy working as Research Officer, scientist- 2 in CCRH. She has coordinated for National Campaign on Homeopathy for mother and child care. Extra-Mural Research Scheme of the Ministry of AYUSH and harmonization of drug proving protocol and clinical research studies.
7.Dr.Kanjaksha Ghosh, BEST RESEARCHER AWARD, he is a renowned medical scientist with more than 750 papers, 31 orations to his credit. He started his carrier as researcher in ICMR and retired as Director, Institute of Immunology Mumbai, under ICMR.
8.Dr.Moonmoon Sinha, BEST RESEARCH PAPER AWARD HOMEOPATHY, she is working as Research Associate, department of Virology Laboratory, Dr. Anjali Chatterjee Regional Research Institute for Homeopathy, Kolkata under CCRH.
9. Dr.Shailendra Saxena, YOUNG SCIENTIST AWARD , HE IS Vice Dean and Professor at Centre for Advance Research [ CFAR], King George’s Medical University , Lucknow and Ex-senior scientist ald leader of Infectious Diseases Group, CCMB, Hyderabad.
Two Days World Homeopathy Day celebration under CCRH has become MARQUEE FOR INDIAN HOMEOPATHY, but many people still doubt if it serves the profession at large or it is like all government programme is becoming a formal annual together of homeopathic fraternity. But even than it is a worthy edition to calendar of events for Indian Homeopathy, hope it continues!!.

FRATERNITY MOURNS THE DEATH OF STALWART VIJAYAKAR
DR.SUSHIL VATS

Dr.Prafful Vijayakar a stalwart of Modern Wave of homeopathy in India died due to COVID19 related complications on 17th December in Mumbai, the city he was born and created ripples all though the homeopathy fraternity in India and abroad. A great homeopath of our time Dr.Vijayakar created the much successful movement of classical homeopathy under the aegis of the PREDICITIVE HOMEOPATHY. He said that homeopathy is Mathematics and that there is no scope of uncertainty in homeopathy, and if the equation between the drug picture and the patient’s picture is well balanced cure is imminent. He termed his approach as Predictive Homeopathy because he thought that we can predict the course of cure once a similimum is prescribed, and for this reason he would say that follow ups are more important than first prescription.
He came into limelight with his first book THEORY OF SUPPRESSION, in which he came with his statement that wrong homeopathic medicines causes suppression as much or sometime more severe than even allopathic medicines, a statement which is even today accepted with pinch of salt. I remember book first published in 1997 got frankly criticized by many well known homeopathic teachers of that time and they thought that this theory of suppression could be a tool in the hands of people who want to bring down homeopathy. But Vijayakar was determined to push forward his understanding of Theory of Suppression and wrote that every time a disease is suppressed, the toxins are pushed upwards and explained this concept with elaboration of THE CHART OF 7 LAYERS OF SUPPRESSION. And this concept of 7 layers of suppression became hallmark of his seminars for much of first decade of his rising as a teacher with new fan following, something which was to get him phenomenal success in years to com
He coined a word for homeopathic similimum THE GENETIC CONSTITUTIONAL SIMILIMUM OR GCS, this became very popular among homeopaths attending his seminars, though it was just a new name to standard homeopathic similimum derived from the Totality of Symptoms of a case. He confessed to this writer many times that Predictive Homeopathy is only my twist to all existing principles and literature of homeopathy. But his obvious intention was to popularise his knowledge and understanding with an edge of branding as he so magnificently did, establishing Predictive homeopathy as a cult thing in young homeopaths. Much in love with him and overwhelmed as much by his teaching as his material success, his followers started writing themselves as Predictive Homeopaths.
Dr.Vijayakar released his second book on THEORY OF ACUTE, in 1999 in a seminar at Jallandhar Punjab organised by Dr.Surmeet Singh Mavi, who soon became his soul mate, they together changed the paradigm of Homeopathic seminars in India. In Theory of Acute Vijayakar wrote that many Materia Medica have been written on therapeutics of fevers and acute diseases, and yet homeopaths find it difficult to get results in such cases. He said lawlessness is the main reason, because all the 7 cardinal principles of homeopathy are not applied and law like that of Hering’s law are bypassed. He takes a dig on run of the mill prescriptions issued by homeopaths without due consideration to homeopathic laws. While advocating new prescribing for acute cases he says that the new concept which i have proposed is not actually a new concept but a rejuvenation of the basic tenets of homeopathy as preached by the masters but not understood by us. This book was much popular among young homeopaths and THE FLOW CHART OF ACUTES , ATTACHED WITH THIS BOOK BECAME AS POPULAR AS THE CHART OF 7 LAYERS OF SUPPRESSION IN THE FIRST BOOK ON SUPPRESSION.
I wrote a serial article in 3 issues of VITAL INFORMER ON HIS 3RD but in my view most significant book THE END OF MYASMTION, my article WIDENING MIASM WITH VIJAYAKAR impressed him and I received a call from him and found he was surprised by my projection of him as someone giving new dimension to the understanding of Miasms, a difficult theory to apply in practice, though we all can talk a lot about it. In this book Vijayakar wrote that the study of modern advances made in pathology and embryology has helped to decode the actual meaning of what Hahnemann could have meant by miasm. Application of this knowledge helped Vijayakar to unravel the mysteries of miasm and thereby helped him to get fantastic results in incurable cases or cases with grave pathologies. In this book Vijayakar said that homeopathicity means not only symptoms similarity or a core similarity or a disease similarity, he means that the similimum should include even the miasm concerned.
This was followed by his first seminar in Vigyan Bhawan, New Delhi, by this time Vijayakar I first met in 1995, has zoomed into an orbit where he was the only one in motion and rest others of his contemporaries were nowhere near him in terms of popularity and also in delivering spell bounding seminars. He was now setting records of highest attended seminars all over the country. His annual Grand Opera of homeopathy in Mahabaleshwer, where National and International homeopaths of eminence were joining year after year made him a cult figure in homeopathy.
ENTERPRENEURRSHIP AND VIJAYAKAR: Just about the time when we thought Vijayakar being as influential on Indian Homeopathy as Kent was in American Homeopathy History, his 4th book Genetic Materia Medica surprised me not for great contents that we were awaiting, he had shared with me his thoughts about tri-maismatic Materia Medica, but more for having a new address on publication line PREDICITIVE HOMEOPATHY CORPORATE OFFICE MAHIM MUMBAI. This was the curve which made Vijayakar more rich but less likeable; suddenly a great teacher was making some decisions not understandable to a reasonable mind .He was now into Certificate Courses, something very controversial and also of doubtful legality and which also became a point of contention between him and his soul mate Dr.Surmeet Singh Mavi. Some close friends raised this to him, but he thought it was the need of the hour. However high cost of these courses in comparison to low cost seminars made it clear that ENTERPRENEURSHIP was guiding the PREDICITVE HOMEOPATHY and many sincere workers who had devoted their time, energy and resources were now left behind.
HOPE FOR THE HOPELESS CAMP: DR. PRAFULL VIJAYAKAR FOUNDATION did a remarkable charity in setting up camps for Children who suffered with congenital disorders and do not have any course of certain treatment in Modern Medicine. Dr. Vijayaykar called these camps as HOPE FOR THE HOPELESS CASES. These camps are organised in different parts of country and are very popular in public, attracting hundreds of patients.
LEGACY: Dr.Ambrish Vijayakar, younger son of Dr.Vijayakar in his condolence message online has said that Dr.Vijayakar had wanted to take homeopathy education to all part of India and abroad and he has promised to continue to take his legacy forward.
My personal fond memories of Dr.Prafull Vijaykar are too many to be captured in this write up but we shared talks on Cricket, well being of homeopaths, love for movies and appreciation of goodness of life. I am at loss because a friend and best homeopath I have known for more than 2 decades is no more.

Oretega as always is very clear about his emphasis when he says that we must investigate all the symptoms both common and particular but first and foremost everything relating to the general symptoms must be investigated. Ortega is also worried about our understanding of patient’s symptoms from homoeopathic perspective- so he sights the examples of symptoms and explain the true color of symptoms it is psoric[blue], sycotic[ yellow] or syphilitic[ red]

Ortega believes in the master like approach even in the investigation of a common symptom because in homoeopathy even the presentation of a common symptom is peculiar to each remedy, thus individuality lies even in a common symptom only if we have developed the skill. It is the characteristic of a common symptom that gives it prescribing importance. Ortega discusses with example of chills and advises that with various other characteristics added to this common symptom we can prescribe a remedy. If patient is shuddering with chills than various remedy can be prescribed depending what type of shuddering is there, he narrates differentiating point of Chelidonium, Camphor, Veratrum album, Bryonia or how chills together with perspiration brings into picture remedies like Euphrasia, Tuberculinum, Lycopodium and Nux Vomica.

Oretega wants us to be very precise in our understanding of the mental symptoms. , Patient’s mental state has shades and as a homoeopath we have to pick the right symptom for the state of patient, for example patient feels hostility to life. But unless we recognize and define the very subtle variants of this feeling we will prescribe a medicine, which does not precisely correspond, to our patient’s psychological state. Ortega cautions us never to deduce mental symptoms psychoanalytically from some other attitudes of the patients, but for the symptom to be correctly taken into account it must be acknowledged by the patient.
Ortega wants us to understand each symptom in each with its miasmatic tint so that we can analyze the case. Fear for example is dominantly Sycosis[ yellow], but if Psora dominates , fear does not attain its full extent, but remains as anxiety, which is prior stage of fear. On the other hand with the large admixture of Syphilis[ red] , fear takes on the characteristics of panicky terror. So the symptom changes in character with the changing miasm in the same patient.

NATIONAL COMMISSION FOR HOMEOPATHY ACT 2020

The President of India gave his assent for the National Commission for Homeopathy Act 2020 on 20th September 2020, a gazette notification to this effect was published on 21st September 2020. The gazette of India CG-DL-E-22092020-221864 EXTRAORDINARY. Presenting the Act in the Rajya Sabha Dr. Harshvardhan, Hon’ble Health Minister said that in 1973 the Parliament had enacted Homeopathy Council Bill. He had requested the first bill for consideration that the central council for homeopathy had failed in its responsibility of creating quality homeopathy education in India. He also said that there were allegations of corruption in recognition of Homeopathic medical colleges by Central Council of Homeopathy. He also said that Central Council of Homeopathy did not cooperate with the government in bringing about transparency in its day to day working. In this background the Government of India had brought an ordinance in 2018 in which Central Council of Homeopathy was dissolved and it was replaced by Board of Governors, to look into the day to day working of the Council. The Ordinance was further extended for one more year because the Government could not pass the National Commission for Homeopathy Act in time frame of one year.
During the discussion, Rajya Sabha member Mr. P. Bhattacharya of Indian National Congress demanded that Homeopathy should be widely used in the treatment of coronavirus cases. He said that Government should immediately give permission for use of homeopathy in all the cases of COVID-19 being treated even in allopathic hospitals. He said there are many patients who have been treated with Homeopathy with good results. He also asked for good publicity for the role of Homeopathy in the treatment of COVID cases by the Government of India agencies.
Another senior Rajya Sabha member, Sudhanshu Trivedi of BJP said that if we want to live hundred year of healthy life systems like homeopathy should be included in day to day uses. He quoted a Sanskrit shloka, to explain that Homeopathy Law of Similars has its genesis in old Indian scriptures.
Shri. Arvind Ganpath Sawant, Shiv Sena M.P. from South Mumbai said that this is unfortunate that homeopathy doctors were not given the opportunity to treat the cases of COVID-19 even though there are well proved cases treated by various homeopathic doctors all over India. he said that there are so many allopathic doctors who even practice homeopathy, which means that homeopathy has capacity to treat all diseases including this pandemic.

An Act to provide for a medical education system that improves access to quality and affordable medical education, ensures availability of adequate and high quality Homoeopathy medical professionals in all parts of the country; that promotes equitable and universal healthcare that encourages community health perspective and makes services of Homoeopathy medical professionals accessible and affordable to all the citizens; that promotes national health goals; that encourages Homoeopathy medical professionals to adopt latest medical research in their work and to contribute to research; that has an objective periodic and transparent assessment of medical institutions and facilitates maintenance of a Homoeopathy medical register for India and enforces high ethical standards in all aspects of medical services; that is flexible to adapt to the changing needs and has an effective grievance redressal mechanism and for matters connected therewith or incidental thereto.
This Act may be called the National Commission for Homoeopathy Act, 2020. It extends to the whole of India. It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint:
The Central Government shall, by notification, constitute a Commission, to be known as the National Commission for Homoeopathy, to exercise the powers conferred upon, and to perform the functions assigned to it, under this Act. The Commission shall be a body corporate by the name aforesaid, having perpetual succession and a common seal, with power, subject to the provisions of this Act, to acquire, hold and dispose of property, both movable and immovable, and to contract, and shall, by the said name, sue or be sued. The head office of the Commission shall be at New Delhi. The Commission shall consist of the following persons, namely:––
(a) a Chairperson;
(b) seven ex officio Members; and
(c) nineteen part-time Members.

The Chairperson shall be a person of outstanding ability, proven administrative capacity and integrity, possessing a postgraduate degree in Homoeopathy from a recognized University and having experience of not less than twenty years in the field of Homoeopathy, out of which at least ten years shall be as a leader in the area of healthcare delivery, growth and development of Homoeopathy or its education.
The following persons shall be appointed by the Central Government as ex officio Members of the Commission, namely:––
(a) the President of the Homoeopathy Education Board;
(b) the President of the Medical Assessment and Rating Board for Homoeopathy;
(c) the President of the Board of Ethics and Registration for Homoeopathy;
(d) Advisor (Homoeopathy) or Joint Secretary to the Government of India in-charge of Homoeopathy, in the Ministry of AYUSH;
(e) the Director, National Institute of Homoeopathy, Kolkata;
(f) the Director, North Eastern Institute of Ayurveda and Homoeopathy, Shillong; and
(g) the Director-General, Central Council for Research in Homoeopathy, Janakpuri, New Delhi.
The following persons shall be appointed by the Central Government as part-time
Members of the Commission, namely:—
(a) three Members to be appointed from amongst persons of ability, integrity and standing, who have special knowledge and professional experience in the areas of Homoeopathy, management, law, health research, science and technology and economics;
(b) ten Members to be appointed on rotational basis from amongst the nominees of the States and Union territories in the Advisory Council for a term of two years in such manner as may be prescribed.
(c) six members to be appointed from amongst the nominees of the States and Union territories, under clause (d) of sub-section (2) of section 11, of the Advisory Council for a term of two years in such manner as may be prescribed: Provided that no Member shall either himself or through any of his family members, directly or indirectly, own or be associated with or have any dealings with the managing body of a private or non-government medical institution which is regulated under this Act.
There shall be a Secretariat for the Commission to be headed by a Secretary, to be appointed by the Central Government in accordance with the provisions of section 5. The Secretary of the Commission shall be a person of proven administrative capacity and integrity, possessing such qualifications and experience as may be prescribed. The Secretary shall be appointed by the Central Government for a term of four years and he shall not be eligible for any extension or re-appointment.
The Secretary shall discharge such functions of the Commission as are assigned to him by the Commission and as may be specified by regulations made under this Act. The Commission may appoint such officers and other employees, as it considers necessary, against the posts created by the Central Government for the efficient discharge of its functions under this Act.
The Commission may engage, in accordance with the procedure specified by regulations, such number of experts and professionals of integrity and outstanding ability, who have special knowledge of Homoeopathy and experience in fields including medical education in Homoeopathy, public health, management, economics, accreditation, patient advocacy, health research, science and technology, administration, finance, accounts or law as it deems necessary, to assist the Commission in the discharge of its functions under this Act.
The Commission shall meet at least once every quarter at such time and place as may be appointed by the Chairperson. The Commission shall perform the following functions, namely:—
(a) lay down policies for maintaining a high quality and high standards in education of Homoeopathy and make necessary regulations in this behalf;
(b) lay down policies for regulating medical institutions, medical researches and medical professionals and make necessary regulations in this behalf;
(c) assess the requirements in healthcare, including human resources for health and healthcare infrastructure and develop a road map for meeting such requirements;
(d) frame guidelines and lay down policies by making such regulations as may be necessary for the proper functioning of the Commission, the Autonomous Boards and the State Medical Councils of Homoeopathy;
(e) ensure coordination among the Autonomous Boards;
(f) take such measures, as may be necessary, to ensure compliance by the State Medical Councils of Homoeopathy of the guidelines framed and regulations made under this Act for their effective functioning under this Act;
(g) exercise appellate jurisdiction with respect to decisions of the Autonomous Boards;
(h) make regulations to ensure observance of professional ethics in Medical profession and to promote ethical conduct during the provision of care by medical practitioners;
(i) frame guidelines for determination of fees and all other charges in respect of fifty per cent. of seats in private medical institutions and deemed to be Universities which are governed under the provisions of this Act.
(j) exercise such other powers and perform such other functions as may be prescribed. All orders and decisions of the Commission shall be authenticated by signature of the Secretary and the Commission may delegate such of its powers on administrative and financial matters, as it deems fit, to the Secretary. The Commission may constitute sub-committees and delegate such of its powers to them as may be necessary to enable them to accomplish specific tasks.

ADVISORY COUNCIL FOR HOMOEOPATHY
The Central Government shall, by notification, constitute an advisory body to be known as the Advisory Council for Homoeopathy. The Council shall consist of a Chairperson and the following Members, namely:—
(a) the Chairperson of the Commission shall be the ex officio Chairperson of the Council;
(b) every Member of the Commission shall be ex officio member of the Council;
(c) one Member, to represent each State, who is the Vice-Chancellor of a University in that State, possessing qualifications in Homoeopathy, to be nominated by that State Government, and one member to represent each Union territory, who is the Vice- Chancellor of a University in that Union territory, possessing qualifications in Homoeopathy, to be nominated by the Ministry of Home Affairs in the Government of India: Provided that where the Vice-Chancellor possessing qualifications in Homoeopathy is not available, a Dean or Head of Faculty possessing qualifications in Homoeopathy shall be nominated;
(d) one member to represent each State and each Union territory from amongst elected members of the State Homoeopathy Medical Council, to be nominated by that State Medical Council;
(e) the Chairman, University Grants Commission;
(f) the Director, National Assessment and Accreditation Council;
(g) four Members to be nominated by the Central Government from amongst persons holding the post of Director in the Indian Institutes of Technology, Indian Institutes of Management and the Indian Institute of Science;
(h) the terms of non-ex officio Members in the Council shall be four years.

NATIONAL EXAMINATION
There shall be a uniform National Eligibility-cum-Entrance Test, for admission to the undergraduate in Homoeopathy in all medical institutions governed under this Act. The Commission shall conduct the National Eligibility-cum-Entrance Test in English and in such other languages, through such designated authority and in such manner, as may be specified by regulations. The Commission shall specify by regulations the manner of conducting common counselling by the designated authority for admission to all the medical institutions governed under this Act: Provided that the common counselling shall be conducted by the designated authority of ––
(i) the Central Government, for All India seats; and
(ii) the State Government, for the remaining seats at the State level.

AUTONOMOUS BOARDS
The Central Government shall, by notification, constitute the following Autonomous Boards, under the overall supervision of the Commission, to perform the functions assigned to such Boards under this Act, namely:—
(a) the Homoeopathy Education Board;
(b) the Medical Assessment and Rating Board for Homoeopathy; and
(c) the Board of Ethics and Registration for Homoeopathy.
Each Board referred to above shall be an autonomous body which shall carry out its functions under this Act in accordance with the regulations made by the Commission. The composition of the Autonomous Boards shall be as under, namely:––
(a) the Homoeopathy Education Board shall consist of a President and four Members from the discipline of Homoeopathy;
(b) the Medical Assessment and Rating Board for Homoeopathy shall consist of a President from the discipline of Homoeopathy and two Members, out of whom one Member shall be from the discipline of Homoeopathy and the other Member shall be an acceditation expert;
(c) the Board of Ethics and Registration for Homoeopathy shall consist of a President from the discipline of Homoeopathy and two Members, out of whom one Member shall be from the discipline of Homoeopathy and the other Member shall be a person who has demonstrated public record of work on medical ethics or chosen from any of the disciplines of quality assurance, public health, law or patient advocacy.
(2) The President and Members of the Autonomous Boards to be chosen under sub-section (1) shall be persons of outstanding ability, proven administrative capacity and integrity, possessing post-graduate degree in respective disciplines from a recognized University and having experience of not less than fifteen years in respective fields, out of which at least seven years shall be as a leader: Provided that seven years as leader in the case of the President and Member from Homoeopathy shall be in the area of health, growth and development of education in Homoeopathy.
