According to the Central Information Comission’s (CIC) July 23 order, a patient’s right to his/her medical records is rooted in articles 19 and 21 of the Constitution.

The hospital authorities have a duty to provide the same under RTI Act, Consumer Protection Act, Medical Council Act and world medical ethics,

Having a copy of your medical records is your right.

Records that must be given to the patient-
discharge summary, referral notes, etc., have to be shared with all patients including those who are discharged against medical advice irrespective if the bill payment has been made.

Records that can be given to the patient after a formal application-
indoor papers, operative notes, investigations, etc., requires a formal application from the patient. The copies of these records given to the patient are generally attested as true copies by the hospital.

Records given only with direction of the court -
some OPD and IPD records, especially those of medico-legal cases cannot be given to the patient without the direction of the Court.

Healthcare is not a one-way street: empowered patients are engaged in their care, actively collaborating with their physicians, sharing responsibility for their care. The providers (doctors, nurses, etc) are still the providers, but the patients share in both the knowledge and the responsibility for how it all turns out.

Thinking from an Indian context, isn't it strange that US citizens didn't have access to their own medical reports earlier?

In India on the other hand, patients always get a copy of their medical reports. That way Indian patients are likely to be more empowered regarding their health.
