Dear Sir,
I received your demand letter and surprised to see the demand. In your demand you asked for Rs 1,60,321 as interest. I am surprised to see the interest figure as i do not have any dues. I have settled the interest of Rs. 39,915.00 when interest issue was raised. : This has been cross verified and confirmed. No interest is due.
Secondly i have paid TDS on your behalf and credit has not been give. As per our records, TDS amount of Rs. 2,33,483/- has been paid by you. Kindly submit TDS Certificates for the same. If there are any more amounts, kindly let us know and the same shall be updated in our system.
Thirdly i demanded As per agreement 3rd November 2014, i was supposed to get possession by November 2015, December, 2016 has passed, we have not received any communication from you regarding possession. As per para 17 on page 30, if the owner fails to hand over the possession of Premises to the purchaser on November 2015, the owner shall be liable to pay the interest as provided under section 8 of Mofa Act, 1963. How you are going to pay the interest as provided under section 8 of Mofa Act, 1963. We sincerely regret the inconvenience that was caused to you on account of such delay. However, please refer the clause 17 of the agreement wherein reasons mentioned on account of which delay be treated beyond scope of developer. In present case of delay which qualifies such conditions for which compensation need not to be paid.
I want the compensation as per above clause and New RARA act,
I request you to send the demand letter only after checking your account properly. It is shame on Runwal for sending demand letter without verification. Please send me the statement. – Apologies for the same sir, however these amounts are system calculated and interest component requires manual intervention, hence the same was sent.
Lastly i would like to inform that i will be taking possession only after you get the OC for building. The interest is not payable till OC is received. – Noted.
