A Penang High Court decision (Mohammad Nabill Sajid v Government of Malaysia & Ors) offers critical insights into:

➡️ The Bolam Test in Malaysia – Why courts defer to "a responsible body of medical opinion" in negligence claims.
➡️ RM4.36M in Assessed Damages – How courts quantify lifelong tetraplegia costs (future care: 85% of the award).
➡️ Judicial Efficiency – Why trial judges must assess damages upfront.
The case underscores the tension between clinical discretion and patient outcomes in spinal cord injury management.

In the landmark case of Woon Kim Choy v Acexide Technology, the Malaysian Court of Appeal affirmed that a director’s title is not the deciding factor in determining whether a director is an employee of a company. What matters is the substance of the relationship and the existence of a genuine contract of service. Our Partner, Lesley Lim, was honoured to speak at the ASEAN–Australia Education Dialogue 2025 in Penang, contributing to a panel discussion on “Gender, Inclusion & Sports Integrity”.

The discussion explored comparative perspectives on Australia’s sports integrity framework and values-based education approach, alongside the Malaysian context, in a robust and engaging exchange with fellow panellists.

We are proud to support our lawyers’ continued involvement in regional dialogue and thought leadership at the intersection of law, sport and education.

Resignations are not always as straightforward as they appear. In today’s workplace, management decisions such as restructuring, transfers, demotions or remuneration adjustments can be perceived as pressure tactics that “push” an employee to leave.

Under Malaysian employment law, a resignation given under such circumstances may be challenged in the Industrial Court. This may result in reputational risk, and significant back-wages or compensation.

This session is designed for employers, business owners, HR leaders, and managers. We will break down how indirect dismissal claims arise, what the Industrial Court looks for, and the common “red-flag” scenarios that turn ordinary HR actions into litigation. Most importantly, the talk will provide practical steps for managing sensitive exits and organisational change confidently while minimising legal exposure.

Join us for a clear, case-based discussion on how to protect your organisation when resignations happen under pressure. Register here: https://tinyurl.com/yztv8z2e

Our Partner, Agalya J. Munusamy, had the honour of serving as a judge at the Moot Court Competition 2025, held on 29–30 November 2025 at the KL Court Complex. The event was jointly organised by the Kuala Lumpur Bar and the Lincoln’s Inn Alumni Association of Malaysia.

This year’s moot problem centred on a complex dispute arising from the Urban Renewal Act. The calibre of the mooters was truly exceptional — their strong command of the legal issues, depth of understanding of the moot problem, and ability to think quickly and respond persuasively under pressure demonstrated advocacy skills well beyond their years. These young lawyers' outstanding performance is a clear indication that the future of advocacy in Malaysia is in very good hands.

At MWKA, we remain committed to supporting platforms that nurture analytical thinking, advocacy skills, and the next generation of legal professionals.

Family-owned companies form the backbone of Malaysia’s economy, built on trust, shared vision, and generational leadership. Yet when relationships break down, that trust can quickly erode, giving rise to disputes that threaten both the family and the business.

Join our corporate litigation lawyers as they discuss how conflicts in family-run businesses can lead to deadlocks, allegations of mismanagement, shareholder oppression, and derivative actions. This session will examine how Malaysian courts address these disputes under the Companies Act 2016, highlighting leading cases and offering practical strategies for resolving family and shareholder conflicts without destroying the business itself.
