Alongside his application to recuse the Chief Justice, Hisyam Teh also made another application to dismiss the appeal, pending their recusal application.
He also noted that the application to recuse the CJ was done out of the "greatest respect".
The recusal application refers to a 2018 Facebook post that criticised Najib. The post was made by, Zamani Ibrahim, who is the husband of Tengku Maimun. Hisyam argued that Maimun could be “unconsciously influenced” by her husband’s sentiments.
Hisyam has invited lawyer Shafee Abdullah for assistance.
“I thought he has been discharged?” Tengku Maimun said.
“I persuaded him,” Hisyam responded.
Shafee informed the court that he had grouses with the team under Zaid Ibrahim and had chosen to remove himself from representing Najib.
“I didnt like the way the letter was represented to my client for purpose of adjournment. I was not happy.”
Maimun reprimanded him, saying “Why you need to go through the history? Let's not waste time going through the merits. We are only interested to proceed with the application.”
Shafee said that he had come to ask for an adjournment until tomorrow morning, and that he can complete his filing submissions then. He added that he needed the adjournment because he is chairing a symposium at 2pm today.
“I am wearing my checkered suit, not my black suit because I came straight here,” he noted.
Maimun rejected his request.
“We find no reason for adjournment so please proceed.”
