NOON: Imagine live-in kayo…bumili kayo ng bahay…tapos NAGHIWALAY. Ay bih 😭

Nasa pangalan ng jowa mo yung title.
May karapatan ka ba sa bahay?

Depende.

Sa Family Code kasi, may 2 klaseng live-in couples:

Couple A (Art. 147)
Yung pwede namang magpakasal pero di lang nagpakasal
👉 Lahat ng nakuha habang nagsasama assumed na hati

Couple B (Art. 148)
Yung hindi pwedeng magpakasal legally
👉 Walang automatic na hati
👉 Kailangan mong patunayan isa-isa na nag-ambag ka
(pambayad, amortization, renovation, gastos, effort, etc.)

Now paano kung same-sex couple kayo?

Dahil walang same-sex marriage sa Pilipinas, napupunta kayo sa Couple B (Art. 148).

Pero dati magulo.

May courts na papayag basta mapatunayan ang share.
May courts na dini-dismiss kasi hindi malinaw saan kayo lulugar.

So sa totoong buhay:

Pag wala pangalan mo sa titulo, madalas talo ka kahit nagbayad ka pa.

NGAYON (Supreme Court ruling):

Nilinaw na ng Supreme Court:

Same-sex couples are under Article 148 at kapag napatunayan mong nag-ambag ka co-owner ka.

Meaning:

Kahit wala pangalan mo sa titulo
Kahit di kayo kasal

Kung may ambag ka may share ka.

Sa actual case that caused this ruling, inamin pa ng partner na around 50% yung bayad ng ex niya.
Result 50-50 co-owners. Pwede na ipahati o ibenta.

So ano ang nagbago?

Hindi pa rin same-sex marriage.
Hindi automatic kalahati.

Ang nagbago:

Di na kayo treated na strangers sa property.
Pag may ambag ka may laban ka na at ngayon makikinig na ang korte.

Small legal clarifcation, big real-life protection.
