Finally, until a sterilizing vaccine is available, the most promising and cost effective treatment to control the pandemic may be a combination drug therapy with or without vaccines provided there is transparency of information on their benefit to risk ratio.

The graduated dosing of IVM to treat COVID-19 based on severity of symptoms and the predilection of the virus to mutate will prove challenging in designing a randomized clinical trial both ethically, morally and scientifically. A more ethical but scientifically sound paradigm to test the effectiveness of treatments for emerging novel infections is imperative because infections is an imminent threat to the security of the world.”

Linawin natin. Maraming nagtatanong sa akin and gusto ko lang ishare bilang it is my sworn duty to uphold the Constitution and the Rule of Law.

Ano ba yang 1987 Constitution? Yan ang pinakamataas na batas natin. Kumbaga, yan ang ating house rules. Walang pwedeng maipasang batas o kautusan na labag diyan.

At present, our Constitution guarantees our RIGHT TO LIFE (bodily integrity), LIBERTY (freedoms, movement, etc.), and PROPERTY (work, monies, and possessions), DUE PROCESS (no summary ex*****on), and EQUAL PROTECTION OF LAWS (no discrimination, unnecessary requirements, or to be treated differently) (Art. III, Sec1) and FREE EXERCISE OF RELIGION (Art. III, Sec. 5).

RA No. 11525 is the prevailing law. Section 12 thereof states that “vaccine cards shall not be considered as an additional mandatory requirement for educational, employment, and other similar government transaction processes.” Hangga’t hindi ito nare-repeal or na-aammend, we, as officers of the court and even all government officials/employees, are supposed to uphold this.

"Art. 286. Grave Coercion. — The penalty of prision correccional and a fine not exceeding Six thousand pesos shall be imposed UPON ANY PERSON WHO, WITHOUT ANY AUTHORITY OF LAW, SHALL, BY MEANS OF VIOLENCE, THREATS OR INTIMIDATION, PREVENT ANOTHER FROM DOING SOMETHING NOT PROHIBITED BY LAW, OR COMPEL HIM TO DO SOMETHING AGAINST HIS WILL, WHETHER IT BE RIGHT OR WRONG.

"If the coercion be committed in violation of the exercise of the right of suffrage, or for the purpose of compelling another to perform any religious act, TO PREVENT HIM FROM EXERCISING SUCH RIGHT OR FROM SO DOING SUCH ACT, the penalty next higher in degree shall be imposed." (Article 286, Revised Penal Code)

Mayroon tayong 3 branches of the government:

1. Legislative Branch (Senators and House of Representatives) – sila ang gumagawa ng mga batas (Republic Acts / Batas Pambansa);

2. Executive Branch (President and His Cabinet) – sila ang tagapagpatupad ng batas; the President makes sure the laws are being properly executed. Meron din siyang quasi-legislative duty, he can make rules (Decrees, Proclamations, Executive Orders, Administrative Orders) that have the force and effect of law. Pero dapat consistent with our prevailing laws and statutes and Constitution;

3. Judiciary (Supreme Court and other courts) – sila ang nag iinterpret ng law and nagaadminister ng justice. Pag may tanong o issue kung tama ba ang pagpapatupad ng batas, dun pumapasok ang judiciary to arbitrate and provide the proper interpretation of law.

Saan pumapasok si IATF?
IATF is an adhoc committee created in 2014 (via EO 168) to address public health emergencies.

Ano ano ang functions nila? Nasa Section 2 yun ng EO 168. Medyo madami, check nyo https://lawphil.net/executive/execord/eo2014/eo_168_2014.html

Pwede ba sila gumawa ng batas? HINDI. Kung may power man sila gumawa ng rules and regulations/guidelines/policies, ito ay merely quasi legislative in nature. Hindi sya kapantay ng batas na tulad ng Republic Act. At kung gagawa man sila ng mga resolutions/guidelines, dapat naka-align o consistent ito sa existing Republic Acts at more importantly, sa ating Constitution.

Pwede ba sila magparusa o magpakulong? HINDI.

Pag may inutos ang Presidente, hindi pwede sabi sabi lang. Kahit pa may pasabi o may pa press release na yung Spokesperson niya. Hanapin natin yung written Executive Order.

Pwede bang magkaroon ng batas na mandatory o compulsory in nature (for example vaccines) na ipapadaan lang sa IATF or Executive Order? HINDI. Kailangan muna may batas. Tandaan, ang IATF at ano mang Executive Order ay dapat pumailalim sa ating Constitution at existing laws.

Pwede bang maglabas ang company namin ng policy naka align dun sa IATF Resolution 148-B, Series 2021 at irequire ako to be vaccinated or else, need ko magpa swab regularly? HINDI. Kasi that would be unconstitutional (against the Constitution) and illegal (against RA No. 11525 and constitues Grave Coercion under Art. 286 of the Revised Penal Code)

Update on COVID-19 situation (17 Nov 2021):

Over the past 7 days, the number of fully vaccinated and non-fully vaccinated cases who are critically ill in the ICU are at 0.6 and 5.2 per 100,000 population respectively.

The number of fully vaccinated and non-fully vaccinated cased who died are 0.1 and 0.9 per 100,000 population respectively.
