Rudyard Kipling was a compulsive storyteller and he loved to make up stories for his Daughter, Josephine. His fanciful absurdities such as “How the Elephant Got His Trunk” and “How the Camel Got His Hump,” had to be told ‘just so’ (in Josephine’s words) or she would be disappointed. In 1902, a collection of these wonderful absurdities was published under the title “Just So Stories.”

My Grandson, Liam, is staying with us for a couple days. This morning we were watching one of his fave YouTube channels called “Awesome” which apparently is a “science-for-kids” platform and in what could have been titled “How the Kangaroo Got His Feet,” it was explaining the Darwinian evolution of the kangaroo (they were actually confusing Lamarckism with Darwinism, but that’s a discussion for another day). While watching the vid, I couldn’t help but think how angry it would have made Darwin (and Lamarck) but how delighted it would have made Kipling.

Western Civ continues its scientific decline, attributable to (what Paul Feyerabend calls) the “consistency condition,” with the propagation of myths that are spoon-fed to children and adults alike disguised as “science,” when in fact, much of what modern Westerners think is science, is really just so.

The current state of panic and public anxiety surrounding the COVID-19 pandemic is not new, and it is not warranted. Those who are screaming "follow the science" the loudest are also those who are denying the science the most.

In the U.S., as well as Western Europe in general, we have a longstanding history of grossly exaggerating what are otherwise mundane public health issues (and in many cases merely creating public health crises where none actually exists).

In the following discussion, I have addressed some of these issues where "science" is highjacked by rear-mongers in search of political power and self-aggrandizement.

Quick update for our friends and clients.

As most of you know, as part of our normal function as forensic scientists, we perform regulatory audits. While doing so, we discovered that Coleen Brisnehan with the Colorado Department of Public Health and Environment, along with Deanne Kelley and Lisa Oliveto with the Tri-County Health Department and Michael Richen with Boulder County Health Department were falsifying and/or helping fraudulent consultants falsify compliance reports on hundreds of methamphetamine contaminated properties across Colorado.

In an effort to cover-up the issue, and discredit us, CDPHE attempted to silence us by hitting us with a notice of violations and a huge fine, falsely claiming that we had violated regulations. As part of their demands, the CDPHE stated they would drop the allegations against us if FACTs closed its doors for business, and never practiced Industrial Hygiene again anywhere in the US and I would have to agree to leave every professional organization to which I belong, and promise to never participate in any such organizations again. We laughed and perservered.

The CDPHE fought desperately to keep the issue out of court. They lost and after a long and arduous battle, we finally were able to take the issue to trial.

In 2018, we won at trial, and we won in spades! Ms. Brisnehan and Ms. Kelly were both caught lying on the stand under oath, and the courts found that the CDPHE had abused its authority and the courts slammed Ms. Brisnehan as duplicitous and unqualified.

The CDPHE appealed the trial decision to their internal legal team who rejected their appeal.

The CDPHE then filed an appeal in Colorado District Court who again slammed CDPHE and called Ms. Brisnehan's actions "capricious and arbitrary." The courts rejected the CDPHE appeal. (This is the court decision that we just got two weeks ago).

After meeting with our attorney on Sunday, we have learned that although we keep winning battles, the CDPHE continues the war, and they have now filed another appeal of the appeal of the appeal.

At this point none of us know if the Supreme Court or the Appellate Court will hear the case. We should know within about six months which court will hear the case. We believe we may then have (another) decision within about 18 months.

Needless to say, taking on the State of Colorado is IMMENSELY expensive and because of the damage done to our business by the false accusations by the State, our business has greatly suffered and we have expanded into other ways of generating income. Yet, we know that the members of the CDPHE, who have now falsely covered up hundreds of contaminated meth-labs in the State, is desperate to not only keep those properties hidden, they are now facing the reality of criminal charges, and they have dug in their heels. Although community regulators continue to ignore actual science and facts, the scientific evidence of over 80 years regarding the wearing of "face masks" continues unabated. Nevertheless, some unscrupulous researchers continue to publish misleading information. Our lead Industrial Hygienist, has been keeping an eye on such publications.

To date, September 20, 2020, there is not a single shred of evidence that supports the idea of community mask wearing as an effective practice to impact the spread of the SARS-CoV-2 virus. Yet the literature is full of junk-science, rush to publish, articles regarding facemasks.

All Too often, water restoration companies forget what their main objective is and perform unnecessary work, costing the homeowner, or building manager unnecessary thousands of dollars. The goal is simple:

1) Correct the water intrusion issue, and
2) clean up the mess.

Usually using fear as the motivator, it is the belief of some remediation companies that the goal during a “mold remediation” job is to leave an abiotic environment. However that is 100% impossible, 100% of the time. In reality, the job is done, when the above two conditions have been met.

Citing Health Canada, and the Canadian Construction Association and the New York City Department of Health, in 2008 the AIHA stated:

*Current mold remediation guidelines support the concept that project success depends on verification primarily through inspection that visible mold growth and associated debris and dust were appropriately removed.*

The US EPA reminds us:

*It is impossible to eliminate all mold and mold spores in the indoor environment.*

The classic New York City Department of Health Mold Guidelines and states:

*The primary objective of mold remediation, based on guidelines published between 1993 and 2004 is to remove visible mold growth and return material surfaces to a satisfactory condition.*

The AIHA states that:

*… the basic practice for identifying mold damage and the process of remediation has been stable since the appearance of the New York City Guidelines in1993 and all cognizant authorities since then have endorsed those approaches. *

Mold remediation performed with negative air machines, moon suits, respiratory protection and magic sterilizing agents are performed mostly for the benefit of bamboozling the homeowner into thinking they are getting value for their money, when in reality, often, “Joe-The-Handyman,” bearing the goals in mind, could have performed the same job in a tenth of the time, for a tenth of the cost.

FACTs recently rebutted a mold report from a Certified Industrial Hygienist who had performed bogus mold sampling and then knowingly falsified the information in his report. The C.I.H. used his bogus “results” to mischaracterize mold exposures in a residence, and claim the exposures resulted in a laundry list of illnesses claimed by the occupant of the home. The occupant of the home was trying to sue the small restoration company for the exposures to “toxic mold.”

Our report, brought science to bear on the matter and FACTs demonstrated the CIH was an unscrupulous, dishonest, unethical Industrial Hygienist who was knowingly performing junk-science work and abusing his ABIH credentials.

We received a very nice letter from the defendant, reproduced below:

Apparently most every mold sampler and inspector have no clue of what they are doing or of the legal problems they cause with their meaningless one shot mold air sampling and incompetent evaluations of the results.

I wonder just how many hundreds of $millions are lost every year on bogus sampling.

It's now affirmed Dr. X###X###x and X###### have a long time scheme going by manipulating mold sampling results, etc. X###### father is a retired doctor, his mother is a retired attorney having all the old school medical connections to make the diagnoses they ''need''

At mediation we were informed that X###x X###x never had cancer, the diagnoses was a "mistake" he had something that resembled cancer.

They played the cancer lie to the very end only recently X###### trying to extort my $15,000.00 bond declaring to my surety that I 'caused' Mr. X###xx' cancer allegedly by a 15 minute 'toxic'' exposure.

Its an all in the family scam to defraud Insurance companies on the 'toxic mold' scare tactic.

The upside I'm a lot wiser today than 3 months ago and our new contract covers me well, now I need good Insurance coverage.
