Quick update for our friends and clients.
As most of you know, as part of our normal function as forensic scientists, we perform regulatory audits. While doing so, we discovered that Coleen Brisnehan with the Colorado Department of Public Health and Environment, along with Deanne Kelley and Lisa Oliveto with the Tri-County Health Department and Michael Richen with Boulder County Health Department were falsifying and/or helping fraudulent consultants falsify compliance reports on hundreds of methamphetamine contaminated properties across Colorado.
In an effort to cover-up the issue, and discredit us, CDPHE attempted to silence us by hitting us with a notice of violations and a huge fine, falsely claiming that we had violated regulations. As part of their demands, the CDPHE stated they would drop the allegations against us if FACTs closed its doors for business, and never practiced Industrial Hygiene again anywhere in the US and I would have to agree to leave every professional organization to which I belong, and promise to never participate in any such organizations again. We laughed and perservered.
The CDPHE fought desperately to keep the issue out of court. They lost and after a long and arduous battle, we finally were able to take the issue to trial.
In 2018, we won at trial, and we won in spades! Ms. Brisnehan and Ms. Kelly were both caught lying on the stand under oath, and the courts found that the CDPHE had abused its authority and the courts slammed Ms. Brisnehan as duplicitous and unqualified.
The CDPHE appealed the trial decision to their internal legal team who rejected their appeal.
The CDPHE then filed an appeal in Colorado District Court who again slammed CDPHE and called Ms. Brisnehan's actions "capricious and arbitrary." The courts rejected the CDPHE appeal. (This is the court decision that we just got two weeks ago).
After meeting with our attorney on Sunday, we have learned that although we keep winning battles, the CDPHE continues the war, and they have now filed another appeal of the appeal of the appeal.
At this point none of us know if the Supreme Court or the Appellate Court will hear the case. We should know within about six months which court will hear the case. We believe we may then have (another) decision within about 18 months.
Needless to say, taking on the State of Colorado is IMMENSELY expensive and because of the damage done to our business by the false accusations by the State, our business has greatly suffered and we have expanded into other ways of generating income. Yet, we know that the members of the CDPHE, who have now falsely covered up hundreds of contaminated meth-labs in the State, is desperate to not only keep those properties hidden, they are now facing the reality of criminal charges, and they have dug in their heels.
