Did you know, the specific phrase “team decision” in the context of the Individuals with Disabilities Education Act (IDEA) is not explicitly defined in the statute. However, the IDEA does outline the composition and responsibilities of the IEP Team, which is responsible for making educational decisions for a child with a disability. This includes decisions about the child’s IEP, placement, and the services they will receive. The term “team decision” would refer to any decision made by this group in accordance with IDEA regulations.

Not many people realize how eligibility for special education works in Oklahoma. Many have been told that it is a “team decision” based on a students “educational need.” This is an omission of truth and fact. While it is partially true, it is deceptive and a form of misinformation in nature.

When a team evaluates a student for a disability under IDEA, on Oklahoma, whichever suspected category the team is suspecting the student as having had required evaluation components necessary for the team to make an informed decision. The key issue here is; the testing results are then applied to the “key eligibility indicators,” which are provided in the 2022 policies and procedures manual for Oklahoma. The evaluation data should dictate whether the student meets the “definition” of that disability under IDEA.

The misinformation is, no where is “educational need” an eligibility indicator. Need is only determined if the IDEA definition is met. If the evaluation does not indicate the student meets “sufficient key eligibility indicators” then “need” is irrelevant.

Food for thought. A diagnosis and failing grades by themselves or in tandem do not constitute eligibility under IDEA. Vice versa, a diagnosis and passing grades should not deny potential eligibility under IDEA.

A DSM-V diagnosis made by a medical doctor or licensed PhD level psychologist is not the same as one of the 13 disability categories under IDEA. So, did you know the category of Autism under IDEA is not the same thing as the ICD or DSM diagnosis of Autism Spectrum Disorder? Did you know that within the school setting, to determine a student is eligible under the IDEA category of Autism, full communication testing by a Speech Language Pathologist is required? Did you know that full communication testing is not required for the ICD or DSM diagnosis of Autism?

Did you know there is a special education rule book for Oklahoma? Did you know Oklahoma has one of the most robust manuals for special education in the US? When a district says “that’s how we do things” why not look it up in the Oklahoma PnP to see if the district is following it! Remember district policies are superseded by the rules and policies in this manual and IDEA.

I specialize in psychoeducational evaluations, behaviors, academic interventions, IDEA and ADA rules, laws, and regulations with a specialization in Oklahoma specific regulations.

If you wish to engage in ny services, I will need to know the school district your child resides as to not create a conflict of interest. I will never ask any district for copies of IEP’s, MEEGS, evaluations, or behavior plans.

All advice and or answers are derived from IDEA/ADA regulations, case law, OSDE guidance, and the 2022 Policies and Procedures Manual for the State of Oklahoma. Each answer will have a specific reference to that information. This information is free to the public. It must be said that any interpretation and information provided by me is not guaranteed to give the answers you want to hear. It is simple black and white answers.
