What happens when HIV criminalization is tied to policing, outdated HIV laws, and systemic racism?

Center for HIV Law & Policy breaks it down in their HIV Is Not A Crime Awareness Day statement and it’s a powerful call to end laws that punish people for their health status.

In this HIV Is Not a Crime Awareness (HINAC) Day statement, CHLP calls for the abolishment of ICE and the repeal of HIV criminalization laws that criminalize the humanity of our communities. We argue for the expansion of the meaning of HINAC Day as HIV criminalization cannot be separated from immigration enforcement, policing, and broader systems of anti-Black and anti-immigrant state violence and those at its intersections.

Grounded in our abolitionist, Black q***r feminist framework, our statement shows how criminalization deepens health inequities and creates barriers to care for marginalized communities. We call for cross-movement solidarity to resist carceral systems and affirm that no person’s health status—or immigration status—should ever be grounds for punishment.

Today we honor HIV Is Not A Crime Awareness Day

We stand with The SERO Project, The Elizabeth Taylor AIDS Foundation, and with partners across the country fighting to end HIV criminalization, including Center for HIV Law & Policy, Equitas Health, Equality Ohio, NMAC, and many more.

Across the country, outdated HIV criminalization laws are still being used to punish people simply for living with HIV, even when there is no intent, no transmission, and no risk.

That must change, because HIV is manageable, it is preventable, and HIV is not a crime.

At OHMM, we recognize HIV Is Not a Crime Day.
HIV is a manageable health condition, not a criminal act. Science has transformed prevention and treatment, but the law has not always kept pace.

Criminalization does not protect public health. It fuels stigma, discourages testing and care, and disproportionately harms Black communities. Modernizing HIV laws means choosing science over fear, care over punishment, and public health over stigma.
