HB 1065 would put certified patients at risk of criminal charges if they are waiting on a renewal card to arrive. Patients listed as active in the state portal should not face prosecution because of a processing delay outside their control.
Affirmative defense simply ensures legitimate patients can protect themselves in court if needed. It does not excuse illegal conduct — it prevents bureaucratic gaps from becoming felony charges.
Seventy percent of South Dakota voters approved medical cannabis. Patients who comply with the law should not be treated as criminals because the mail hasn’t arrived yet.
