The Next Phase of HIPAA: Are You Ready?

Home health and hospice leaders should be preparing now for what could become the most significant update to the HIPAA Security Rule in more than a decade. The U.S. Department of Health and Human Services Office for Civil Rights (OCR) has proposed sweeping changes designed to strengthen cybersecurity protections for electronic protected health information in response to escalating ransomware attacks, data breaches, and persistent compliance failures across healthcare.

A final rule is currently projected for May 2026, with most requirements likely to take effect by late 2026 or early 2027. While the exact timeline remains uncertain, the direction is clear. Regulators are moving from flexibility to prescriptive, enforceable standards.

Why HIPAA Is Changing Now
The healthcare environment has changed dramatically since the Security Rule was first implemented. Today’s care delivery model includes cloud hosted systems, telehealth platforms, mobile devices in the field, connected medical equipment, health information exchanges, and artificial intelligence tools. At the same time, cyberattacks have surged, disrupting care and exposing sensitive patient information. OCR investigations consistently identify the same weaknesses: incomplete risk analyses, inadequate technical safeguards, and poor vendor oversight.

The proposed updates respond directly to these gaps.

When people feel valued, they don’t just comply they are committed. Cultures rooted in appreciation and respect create teams that are resilient, loyal, and willing to go the extra mile for one another.

Leadership love isn’t always soft or sentimental. It’s often demonstrated through hard conversations, clear expectations, and the courage to address issues early rather than letting them linger. They show up steady, fair, and present, creating environments where trust can grow and where people know they belong even on the difficult days.

On February 3, 2026, Congress passed and the President signed the Consolidated Appropriations Act, 2026 ending the government shutdown. This legislation includes Continuing Resolution (CR) which funds most of the government through September 30, 2026. In addition to funding the government, the legislation includes several provisions important to the care at home community, including the extension of telehealth, as outlined below.

The Alliance is pleased to see an extension of telehealth flexibilities through December 31, 2027; however, we are concerned about the implementation of the limitations on the use of telehealth for the face-to-face encounters for some hospices. The Alliance recognizes that it will take some time for CMS to implement the parameters and we spoke to CMS about this today. In that discussion, CMS indicated that the Agency needs to think through implementation and will try to provide as much notice as possible before anything goes in place for these new telehealth guardrails. The Alliance is working to make this as seamless as possible for providers and will provide updates as they become available.

By February, leadership starts to feel different. The goals looked good a few weeks ago, but now the work is real and the momentum isn’t as loud. That doesn’t mean you aimed too high or missed something along the way. It simply means you’ve moved from planning into practice. Resilient leaders recognize this shift and resist the urge to quit or constantly rework the plan. They stay steady and keep showing up.

If this season feels heavier than you expected, try a few simple resets. Narrow your focus to one priority that truly moves things forward this week. Ask your team what’s working and what’s not and be willing to adjust without losing sight of the bigger picture. And don’t underestimate the power of encouragement, call out effort, not just results.
