Another state has joined California, Oregon, and Washington in creating regulatory standards designed to protect outdoor workers exposed to wildfire smoke.
Nevada has enacted comprehensive employer requirements that took effect January 1, 2026. Nevada SB 260 requires covered employers to establish and implement written mitigation programs, monitor air quality according to the EPA Air Quality Index (AQI) from AirNow, train employees, and establish communication systems to inform employees when they are being exposed to air quality where the AQI is 150 or more during their shift.
Additional regulatory measures still to come include establishing specific measures employers must take when the AQI is 150 or more, but less than 200, and then when AQI is 200 or more.
