North Dakota stands alone as the only state with a distinct pharmacy ownership law. Since 1963, legislation has required that any pharmacy in the state be majority-owned by licensed pharmacists. This ensures that the professionals dispensing medication are also the ones calling the shots.
This regulation effectively blocks large corporate chains from taking over the market. While a few pre-existing chain locations were grandfathered in, others face strict limits; for instance, a Walgreens in Fargo operates as a retail store but is legally barred from running a pharmacy inside.
Despite challenges, including a significant 2014 push by Walmart to change the rules, voters decided to keep the law in place. As a result, the state continues to feature a unique landscape thriving with independent, locally owned pharmacies in communities of all sizes.
