Answers To Your New Massachusetts Seller Withholding Regulation Questions

As you may know, on November 1, 2025, a new regulation will go into effect requiring that a portion of proceeds be withheld on transactions over $1,000,000.00 when a seller is not a Massachusetts resident. As Realtors and mortgage professionals, this new regulation will affect many discussions with your clients moving forward.

As with any significant change, a succinct explanation of the regulation's facts is important to make sure implementation is properly handled. To make sure that's the case, Kriss Law is pleased to offer a review of the new regulation along with answers to all questions related thereto.



Attorney Scott Kriss will discuss topics ranging from how Realtors' day-to-day seller conversations will be changed, to the best way to speak to potential clients about when the regulation applies. For lenders, the regulation will certainly be a topic for those clients that are selling and buying simultaneously.
