Many people assume that when a loved one passes away, holding power of attorney or guardianship gives them the right to control disposition — but that authority ends at death and no longer grants legal decision-making power.

Pursuant to KRS 367.93117, the legal right to make final disposition arrangements follows a specific order, beginning with the surviving spouse, then adult children (biological and legally adopted), with decisions controlled by majority. Next are the surviving parent(s) — if one parent is absent, the present parent may act after giving reasonable notice. Authority then passes to adult grandchildren and adult siblings, also controlled by majority. If none are available, the right follows next-of-kin order pursuant to KRS 391.010.

Consider these gentle ways to offer comfort and care to someone who is grieving.

🌹Be present and listen: Simply being there and offering a listening ear without trying to fix their feelings can be very comforting. Let them talk when they’re ready and listen without judgment.
🌹Use thoughtful words: Acknowledge the loss with sincere, compassionate statements rather than clichés or platitudes.
🌹Offer practical help: Grief can make everyday tasks hard — bringing meals, running errands, or helping with chores can make a real difference.
🌹Check in consistently: Support is most needed not just right after the loss but in the weeks and months that follow.
🌹Respect their process: Everyone grieves differently. Be patient and flexible, and let them guide how and when they want to share or spend time together.

A Kentucky Funeral Planning Declaration is a legal document that lets you clearly state your funeral wishes and choose who will carry them out. By completing the FPD-1 form, you can name a designee—especially helpful if you want someone other than your legal next of kin—or provide specific instructions for your arrangements.

The form must include your name, age, and clear directions. While the declaration provides legal clarity and peace of mind, the funeral must be properly funded for the arrangements to be legally binding.

Rachel Marie Hoke

Rachel (Spence) Hoke, age 83, peacefully departed this life on January 26, 2026, at Redbanks Skilled Nursing Home in the Harbor Unit. Born on May 30, 1942, to the late George and Leona Spence, Rachel's journey through life exemplified her deep love for family, friends, and the communities she cherished.

Rachel made her home in Henderson County in 2020, when she moved in with her son, James, as her health began to decline. Though her later years took her from the mountains of West Virginia, where she had built a life surrounded by close friends and family, her heart remained intertwined with the memories and bonds formed there. She was known as a devoted mother, a loving sister, and a steadfast friend, leaving an indelible mark on everyone she met.

Preceded in death by her infant son, Jesse Gilley, as well as her first husband, Roy Gilley, and her second husband, Lonnie Hoke, Rachel also grieved the passing of 11 siblings. Her love and legacy continue to shine brightly through her surviving son, James Gilley, and daughter-in-law, Cindy; her sister, Shelva Wills; and her brother, Edwin Spence, both of whom reside in West Virginia.

The family would like to express their heartfelt gratitude to the staff at the Harbor Unit for the compassionate care and friendship they extended to Rachel during her time there, especially to Molly and Terry in the laundry room, who became cherished friends in her final days.

A private burial will take place at Springdale Cemetery, where close friends and family members will gather to celebrate Rachel's life and share their memories. The date of this reflection and remembrance will be communicated soon.

As we say goodbye to Rachel, we cherish the lessons she taught us about love, kindness, and resilience, and we hold her memory close to our hearts.
