A nanny work agreement — sometimes called a nanny contract or work agreement — is one of the most important tools for setting a healthy, professional working relationship between a family and their nanny. It doesn't have to be intimidating! Think of it as a written conversation that protects everyone involved.
Here are some key sections to consider including and some language tips for each:

💰 Compensation & Hours
Be specific here. Instead of "competitive pay," write out the exact hourly rate, the guaranteed hours (e.g., "a minimum of 40 hours per week"), and how overtime will be handled. Keep in mind that overtime must be paid at time and a half — this is required by law, not optional. Vague language around pay is one of the most common sources of conflict.

📋 Duties & Responsibilities
List out what is — and isn't — expected. Language like "child-related duties include..." followed by a clear list avoids the classic "that wasn't in my job description" conversation. If household tasks are included, spell those out separately too. Be cautious of vague phrases like "but not limited to" — this is a red flag in any work agreement. Language like this leaves the door open for unlimited expectations and can be used to justify asking for tasks that were never discussed or agreed upon. If you see this phrase anywhere in an agreement, ask for it to be replaced with a defined, specific list.

🌴 Time Off & Benefits
Specify paid holidays, vacation days, and sick time. Note whether paid time off is accrued or given upfront. For example: "The nanny will receive 10 days of paid vacation after 90 days of employment." Clarity here prevents a lot of misunderstandings down the road.

🔒 Confidentiality & Privacy
Many families include a confidentiality clause asking the nanny not to share photos of the children or details about the family's home and lifestyle on social media. Language might read: "The nanny agrees to maintain the privacy of the family and will not post photos or identifying information about the children or household on any public platform without prior written consent."

⏳ Trial Period
A trial period gives both parties a chance to make sure the fit is right. Keep in mind that a trial should typically be no more than a day or two — and it must always be paid. Be cautious of any agreement that proposes an extended unpaid trial, as this is another red flag. Something like: "A paid trial of [X day(s)] will be completed prior to the start of employment, during which either party may determine if the placement is a good fit."

🚪 Termination & Notice
Outline how either party can end the agreement and how much notice is required. Be sure to include language for both voluntary resignation and termination, as the notice expectations may differ.

📝 A Few General Tips on Wording:

Use plain, clear language — no one should need a law degree to read it
Avoid terms like "as needed" or "reasonable" without defining what that means
Watch out for phrases like "but not limited to" anywhere in the agreement — this is red flag verbiage that creates open-ended obligations with no boundaries
Always review any legal verbiage carefully — agreements can contain hidden clauses or language that, if you fully understood what it meant, you may not have agreed to sign. When in doubt, ask questions or seek guidance before signing anything
