Psilocybin Therapy State Series

This Week's State Spotlight: Alaska 🌨️❄️

In 2024, the Alaska Legislature passed House Bill 228, creating a task force to study the licensing and regulation of psychedelic-assisted therapy in anticipation of potential FDA approval.
This task force released recommendations in May 2025 and again in early 2026, focusing on preparing state regulations for therapeutic use.

A poll indicated that nearly half (49.4%) of Alaskan adults supported a ballot measure to remove criminal penalties for psilocybin, with support rising to 65% when informed of its potential to treat mental illnesses. People are open to the medicine!

A campaign to legalize certain psychedelics, including psilocybin and DMT, for adults 21+ originally aimed for the 2026 ballot, but did not gather enough signatures by the deadline. Organizers have since shifted their focus to a revised 2028 ballot effort.

On February 4, 2026, the Alaska Legislative Task Force for the Regulation of Psychedelic Medicines released its final report: It recommends that Alaska needs to proactively prepare to allow the use of psychedelic medicine (including psilocybin) should FDA-approved therapies emerge, rather than defaulting to prohibition.

Altogether, all of these efforts lay important groundwork for future medical access, regulatory frameworks, and public health planning in Alaska.

Psilocybin Therapy State Series

This Week's State Spotlight: New Jersey

New Jersey just officially signed a bill creating a state-run, hospital-based psilocybin therapy research pilot, which included $6 million in funding.

Earlier versions of the bill contained broader language about regulated adult access and decriminalization, but those provisions were removed to focus on structured medical research.

The pilot program is designed to study how psilocybin-assisted therapy may support people living with serious behavioral health conditions, including treatment-resistant depression, PTSD, anxiety, and substance use disorders. A state-appointed advisory board will oversee safety protocols, ethics, and outcomes, and the findings from this multi-year program will be reported back to lawmakers to help determine what comes next.

Its important to note, however, that New Jersey has not fully legalized or decriminalized psilocybin, which means that the public still has no access to the medicine. This legislation focuses specifically on structured clinical research, not public access.

Unfortunately, possession, cultivation, and personal use laws remain unchanged.

Still, this absolutely matters! By doing this, New Jersey is signaling that psilocybin therapy is being taken seriously at the state level. The research is there, and it can no longer be ignored!

Progress isn't happening fast, but it IS happening!

🚨 BREAKING NEWS 🗞️

New Jersey has become the 4th U.S. state to approve psilocybin-assisted therapy, and the 2nd to do so within a medical framework.

Governor Phil Murphy signed the law in his final days in office (January 19th, 2026) creating a pilot program for therapeutic psilocybin use, positioning New Jersey as one of the first few states to study it in a medical setting.

Psilocybin will be administered for therapeutic purposes at three selected hospitals: north, central, and south Jersey. The law, however, does not legalize at-home or recreational use.

The state has allocated $6 million for the "Psilocybin Behavioral Health Access and Therapy Pilot Program", which will run for two years.

🎉This is a major victory for mental health. Change is happening!

Psilocybin Therapy State Series

🌄 This Week's State Spotlight: Utah

Utah may not be the first state that comes to mind when you think of psychedelic reform, but meaningful progress IS happening!

Back in March 2024, Utah lawmakers approved a pilot program: Senate Bill 266, creating a three-year pilot program that allows psilocybin and M**A to be administered as therapeutic tools in clinical settings at two major health systems: University of Utah Health and Intermountain Healthcare. The bill became law when Gov. Spencer Cox let it take effect without his signature due to overwhelming legislative support!

While psilocybin remains illegal outside of these medical programs, Utah’s approach reflects a growing trend: even traditionally conservative states are beginning to explore evidence-based psychedelic therapies rather than dismiss them outright.

Data from this pilot will be reported back to lawmakers in the coming years, making Utah a state to watch as the national conversation around therapeutic psilocybin continues to evolve.

Psilocybin is still illegal outside of these controlled settings in Utah, classified as a Schedule I controlled substance under state law. However, advocacy groups, like the Utah Patients Coalition, continue pushing for broader therapeutic access and legislative change.

📊👉 2026 is a big year! As pilot program data comes in, the Utah Legislature will have hard evidence to decide whether to continue, expand, or refine therapies using psilocybin and M**A.

✨ Progress doesn’t always look like full legalization... sometimes it starts with cautious, science-driven baby steps.
