✨ Florida – Intellectual Property & Brand Protection Notice ✨
All products, formulations, product names, branding, creative content, and proprietary materials offered by Lotus Wellness (and any affiliated brands, product lines, or educational content) are original and uniquely developed by me as the sole creator.
This includes — but is not limited to:
• Product names, product lines, and branding
• Herbal formulations, ingredient combinations, and product concepts
• Marketing content, packaging, and presentation
• Educational materials, protocols, and business assets
These elements are protected under applicable intellectual property laws, including federal trademark and copyright law (e.g., the Lanham Act) and Florida state intellectual property and unfair competition principles, which protect businesses from confusion, misrepresentation, and unauthorized use of another’s brand identifiers.
Under Florida law, trademarks, product identifiers, and brand names are protected against unauthorized use that causes consumer confusion or unfair competition. Trademarks and related rights may be enforceable at both the federal level and under the Florida Trademark Act, which allows enforcement and legal remedies against infringers.
Additionally, Florida’s trade secret laws and unfair competition doctrines protect proprietary information and unique business assets where reasonable measures are taken to maintain confidentiality and ownership.
Notice to Competitors & the Public:
• Unauthorized replication, imitation, or copying of Lotus Wellness products, names, branding, or proprietary combinations — including substantially similar names, ingredient combinations, or marketplace presentation that could cause confusion — is prohibited.
• Use of names, branding, formulations, packaging, or marketing that is likely to cause confusion with Lotus Wellness offerings may constitute trademark infringement, unfair competition, or deceptive trade practices under Florida law and federal law.
Enforcement & Legal Action:
If unauthorized use or imitation is identified, Lotus Wellness will take appropriate action to protect its intellectual property and brand, which may include:
• Issuing a formal cease and desist demand
• Pursuing injunctive relief or monetary damages
• Seeking enforcement through Florida state courts and/or federal courts
This notice is intended to establish public documentation of original ownership and intent to protect proprietary rights.
I fully support creativity, ethical inspiration, and collaboration — but I do not consent to unauthorized replication, brand confusion, or misrepresentation of my original work.
