We are confident that I already know two individuals who will assist, but I am concerned that I will only receive about four responses, as this is a pressing concern. Twenty-two Veterans succumb to their struggles daily. May I request that two friends or family members copy and re-post this message? A Message from the Department of Medical Assistance Services (DMAS)

DMAS submitted waiver amendments on September 20, 2024 with a proposed effective date of January 1, 2025. These amendments included finalizing rules regarding when a Legally Responsible Individual (LRI) is the paid Attendant.

As of this date, DMAS has not received approval from the Centers for Medicare and Medicaid Services (CMS) on finalizing rules for LRIs. No changes will be made January 1, 2025.

The current rules remain in effect. As a reminder, the current rules state:
LRI payments will be limited to 40 hours per week. LRIs are permitted to find other caregivers for the additional hours approved in the plan of care.
Respite will not be available when there is a paid LRI.

Once DMAS receives federal approval, additional communication will be released.
