Clarification of ORC 5905.18 – Use of HEA Form 2739 for Veteran’s Benefits

A review of Ohio Revised Code (ORC) 5905.18 has identified that the long-standing practice of funeral directors using HEA Form 2739 to request a free certified death certificate for the family of a deceased veteran is not authorized under statute. ORC 5905.18 provides that when a public record is required by the U.S. Department of Veterans Affairs (VA) to determine eligibility for veterans’ benefits, the custodian of the record shall provide a certified copy without charge to:

• The applicant for benefits
• A person acting on the applicant’s behalf
• An authorized representative of the Veterans Administration

Based on this statutory language, HEA Form 2739 should only be completed and submitted by an authorized VA representative or veterans service officer assisting a family in obtaining documentation necessary for veterans’ benefits. Funeral directors are not authorized to determine which records are required for VA benefits and should not complete or submit HEA Form 2739 in place of a VA representative.

Local vital statistics offices have been notified that HEA Form 2739 should only be accepted when submitted by an authorized VA representative or veterans service officer. Families seeking documentation for veterans’ benefits should be referred to the U.S.
Department of Veterans Affairs or a local veteran’s service organization, which can assist with determining required records and completing the appropriate forms.
