ALERT TO LOUISVILLE LMTs

By January 30, 2026 Louisville Metro Health Department will have a page for LMTs to apply for the now required Massage Establishment license. The application must be done within 60 days (end of March) or the LMT will face penalties. The page will also have a copy of the ordinance posted.

This is required for all LMTs in the Louisville Metro limits who are incorporated or have LLC or other corporate status with Ky State Corporation Commission. Sole Proprietors are NOT required to have this license to continue their work in Louisville.

Connie Mendal, Chief Health Strategist for the Metro Department of Health and Wellness, stated that the department will initially prioritize those businesses known to be operating without an LMT and who have been reported by concerned citizens as being a cover for non-massage activity. Eventually all massage businesses holding this license will be inspected.

Like their inspections of hotels, restaurants, etc., the inspectors will focus upon sanitation. They will ask if the business is keeping the Registry of clients as required in metro ordinance passed in November but will not be collecting or reviewing it. They will be looking for compliance with other standards such as separate storage for dirty linens, display of LMT license, and display of the Human Trafficking notices.

They will not make an appointment for the inspection, but will not enter a room where a session is ongoing with a client. She said they “will wait.” They will inspect all the LMTs at a single location in one inspection.

It is important to note: If the business has multiple LMT’s working in one office suite but they are not employees, and book separately, then EACH of the LMTs must acquire this license. Only if the LMTs are on payroll under the corporate umbrella will they all not need to get an establishment license from the city, just one for the entire business will work. Even if all contractors are operating under the one banner, if they are individually incorporated and the client pays them directly, then they need their own license. I will be working to change this but it may take a while.

The health department inspectors know that some massage modalities are done on the floor, using floor mats and that pillows are used for positioning clients in a massage room. These will not be a problem. They also will not be looking for your security cameras.

She noted that you should be compiling and maintaining your registry, a list of “patrons”, with their first and last names, date and time of service, type of service received and first and last name of the massage therapist.

At this time, she and the original members of the task force are determined to wait “6-12 months” before allowing any amendments to the ordinance. I believe I was able to make clear the importance of amending to remove the 2nd sentence from 115.184 OPERATING REGULATIONS subsection (E). This sentence is in direct violation of both our state licensing law and Code of Ethics in regulations. It states “Any contact with a patron’s sexual or ge***al areas is strictly prohibited unless under direct orders of a licensed medical professional.” Orders or no orders, ge***al contact is forbidden to LMTs in this and most states. A client needing any therapy on ge***als or a**s should be referred to an appropriately trained PT or physician. An LMT can lose their license for ge***al contact.

The made great points to back us up and James has offered a model city code from one he helped develop for Sonora CO. This is happening all over the country as human trafficking is changing in its mechanisms and types of victims, and legislators and local governments are taking misguided stabs at how to get ahead of it.
