Late last year, we issued a call to action regarding the New Jersey Legislature’s fast-tracking of S4510/A5761, a bill that places therapists in ethically untenable positions and limits access to clinically appropriate family therapy. We deeply appreciate those of you who responded to our call to action and made your voices heard.
Despite these efforts and the serious concerns raised by the mental health community, the bill has since passed and was signed into law by former Governor Murphy.
As you know, NJAMFT has established a collaborative relationship with Carolyn N. Daly, Esq., a family law attorney with deep expertise in custody and family court matters. Ms. Daly has authored the following article to provide important analysis and guidance for those impacted by this law, including mental health professionals and the children and families we serve.
We encourage members to review and share the article on Ms. Daly's firm’s website: Recalibrating Custody Adjudication in New Jersey: Child Safety, Judicial Discretion and the Limits of Legislative Design - Cohen Seglias.
This article offers critical insight into the legal and clinical implications of the new law and its potential effects on child safety, judicial discretion, and therapeutic practice.
