We need YOU to submit written testimony by 3/2/26 at 3:00PM ET. Your family and friends could write testimony in support of the protection healthcare providers of CT need from unregulated insurance clawback practices. When YOUR insurance company claws back money paid to a provder, YOU pay the bill! Patient can and should support this bill.
This template reflects my interpretation and perspective on the current language of SB 341 and HB 5377. Please feel free to adapt it to reflect your own experiences and opinions when submitting testimony:
Subject: Testimony on SB 341 and HB 5377 – Support and Request for Amendments
Dear Members of the Insurance Committee,
I am a mental health provider in Connecticut and I am writing regarding in support of SB 341 and HB 5377.
I support:
Shortening the clawback period to 12 months
Maintaining recoupment for fraud and duplicate payments
Providing clear and timely recoupment and appeals processes
I urge the Committee to amend the bills because the current language leaves providers vulnerable:
Section 1(D) & (E): Allows insurers to recoup payments indefinitely if they later determine there was no coverage or another payer is responsible. Providers should not bear financial responsibility for errors in insurer eligibility systems.
Section 1(B): Allows clawbacks if a provider “did not bill appropriately based on documentation,” which is subjective and could expose providers to indefinite audits for good-faith billing decisions.
Amending these sections will protect providers from insurer system errors and overly broad clawback audits, ensuring continued access to care for patients.
