Government Oversight- Several years ago the Banking Commission of SC initiated legal action against our company to have it report to them and not separate Probate Courts throughout the state, saying companies doing business as Guardian, Conservator, POA, and Estate Representative have to get authorized through them. Action was brought to the SC Court in Georgetown, we won. The decision was appealed and was heard by a three member Appeals Court and we lost. We appealed to SC Supreme Court. Two weeks ago, the Supreme Court agreed to hear our case. This in itself is historic.
We try to protect others and help them at the worse time of their lives. Many see this action against us as a negative, but most attorneys see this as us fighting for the rights of others, and agree jurisdiction should be left to county courts. Additionally they look up to us for fighting the battle that most were afraid to fight. I received over 100 phone calls when this stated from other companies who said they do the same, I asked if they wanted to participate in the legal action, all asked that they not be identified, this declined. Any attorney who does not see fighting this battle is worthy, then they themselves need to look at why they are doing this work and don’t really care about their clients.
This will impact every state in the united state.
