⚖️ Does your family actually need probate in Texas? The answer might surprise you!
This is one of those topics nobody likes to think about — but being informed now can save your family thousands of dollars and a lot of heartache later. Texas estate attorney Thomas Fortenberry breaks it down in a way that's easy to understand.
Here are a few key things to know:
👨‍👩‍👦 Family structure matters. If you have a traditional family where all children come from the same marriage, you might not need probate at all. But in a blended family, probate is almost always required — because skipping it can leave a surviving spouse co-owning property with the deceased spouse's children. silverleaflegal
📜 What the will says makes a big difference. If the will leaves anything other than all children taking equally — such as gifts to grandchildren, charities, or unequal distributions — you'll need to go through probate. silverleaflegal
🏠 There may be a simpler option for property. Texas law provides an alternative called an Affidavit of Heirship that can transfer title to homes, land, and vehicles without ever setting foot in court — saving families thousands compared to full probate. silverleaflegal
