The FDA has sent warning letters to 18 websites for illegally marketing and selling counterfeit or unapproved versions of botulinum toxin and similar injectable products following reports of adverse events associated with the products. ASDSA encourages patients to ensure medical procedures use FDA-approved products and are performed or supervised by an onsite physician, especially by a board certified dermatologist. A medical spa owner in Minnesota is facing charges after posing as a registered nurse, lying about having a medical director and injecting patients with what she called “black market” botulinum toxin. ASDSA urges patients to ensure medical procedures are performed or supervised by an onsite physician, especially by a board certified dermatologist. Today, Oct. 21, 2025, the Centers for Medicare & Medicaid Services (CMS) updated its Medicare claims hold guidance to Medicare Administrative Contractors. CMS instructed all Medicare Administrative Contractors (MACs) to lift the claims hold and process claims with dates of service of Oct. 1, 2025, and later for certain services impacted by select expired Medicare legislative payment provisions passed under the ’25 Full-Year Continuing Appropriations and Extensions Act. This includes claims paid under the Medicare Physician Fee Schedule. Visit https://go.cms.gov/3L2fZOj view the CMS guidance.

“Impostor nurses” take the credentials of someone with a similar or the same name and then treat patients, despite having no training or education. Patients deserve to make informed decisions about from whom they receive medical treatment. ASDSA supports disclosure of level of licensure in medical advertisements and communications, as well as posting this information in health care settings and on photo identification badges in patient-interactions. Multiple people were arrested in Texas for practicing medicine in a medical spa without a license - one claiming to be a doctor and the other “nurse certified”. After performing injections and other procedures, there were allegedly patient injuries, including a punctured nerve. ASDSA encourages patients to ensure medical procedures are performed or directly supervised by a physician, especially by a board certified dermatologist as recommended in the “Medical Spa Safety Act,” and supports disclosure of level of licensure in medical advertisements and communications, as well as posting this information in health care settings and on ID badges in patient-interactions. The FDA has launched a database that allows the public to view reports of adverse events for cosmetic products, allowing medical professionals, patients, and consumers the ability to review the potential safety of a product. If you encounter any adverse events in patients caused by cosmetic products, you may report them to the FDA’s MedWatch. Additionally, any adverse events associated with a medical procedure can also be reported to MedWatch and ASDSA/Northwestern University’s Cutaneous Procedures Adverse Events Reporting (CAPER) registry at caper.net. A woman in Texas is facing felony charges for operating a medical spa unlicensed and falsely presenting herself as a nurse. Patients deserve to make informed decisions about from whom they receive medical treatment. A recent study co-authored by ASDSA members Ann Haas, MD, and Elan Newman, MD, highlights widespread patient confusion over the professional titles used by non-physicians. Only 9% of the 1,000 adults surveyed across California could correctly match a practitioner's level of training and qualifications with the appropriate medical or specialty title, while 91% said accurate understanding was essential for informed consent.

The findings reinforce ASDSA’s advocacy for title transparency in medical advertising, requiring clear disclosure of licensure and board certification and protecting physician-specific terms such as “medical doctor,” “doctor of osteopathic medicine” and “board certified dermatologist” to safeguard patients and ensure informed decision-making.
