Feb 10th 2014 Meeting between Cindy George, Shawn Ammon and Carl Christofferson at the Lincoln County Planning Dept with Onno Husing.
He provided TC zoning after pulling maps for 41 Olalla Rd. Toledo Or' site of future Going Green West Coast Compassion Center.
Feb 10th 2014 followed up with Craig Kelson same day to sign lease after meeting Onno Husing Planner Lincoln County.
We had less than 2 weeks to follow all requirments in order to open 3-3-2014
February 26, 2014, Lincoln County called an emergency,Lincoln County board of Commissioners adopted Ordinance No. 472, temporary moratorium. The State of Oregon had already been very clear that the State did not allow Cities or Counties to ban the legal medical rights of the sick patients of Oregon. So they chose to declare it an Emergency to violate the majority vote of their constituants.
I believe this was the beginning of the corrupt targeting of only Going Green West. It has been revealed through Onno Husings own recorded hearing on 6-13-2022 he was unaware of the issue at the time we inquired at the planning office. It was only this piece of property in all of Lincoln County. Like myself, we relied on the zoning as presented not some back door deal over 30 yrs ago where it also was revealed the county failed their due dilligence to make sure all requirments were fullfilled in 1983. Regardless the property was used for multiple uses and changed many times without an issue until we moved in.
From 3-4-2014 until the filing of the complaint, Lincoln County violated the laws and slandered my facility as illegal and unregulated which was the second assertion of fraud by targeting a licensed legal medical provider as illegal.
The first fraud is stated in Onno Husings declaritory statement that I was only provided with, after many request in a legal form. In his statement was is the first false statement and which this whole case relied upon. He states he only learned of our facility after we opened which would mean I never followed my due dilligence in the planning department, this is the reason I was never allowed or any attorney was ever allowed to cross exam the lies in this record by officials.
All of this history has never change in the 11 years I have sought justice for these false statements and the illegal taking of my buisness.
Tobias Tingleaf was the second lawyer for our landlord Craig Kelson. The first appeared before the Lincoln County Commissioners to inform Commissioner Doug Hunt the next door neighbor of our medical facility, that as the Lincoln County Commissioner, he should not vote with a conflict of interest and long history of conflict over this location. At that hearing only two Commissioners were present and one was conflicted. Doug Hunt chose to ignore the request.
4-29-15 David Gordon was Mr. Kelsons attorney at the Lincoln County Board Meeting. The two Lincoln County Commissioners voted to impliment a moratorium on only my facility while actually changing zoning requirments for a unopened facility in South Beach. It was located too close to a State Park, which was clearly a violation of the zoning regulations implimennted by the State. They voted Ryan Bledsoe be allowed to locate a new facility near the State park but we were a nuesence.
The landlords first Attorney passed away or health was failing so Tobias Tingleaf was hired by Mr, Kelson. We were represented by David Moule. Together we filed an appeal and were scheduled to court June 10th 2017
In this complaint right from the beginning, the planning department puts forth the fraud,
"In or around May 2014, the Lincoln County Department of Planning and
Development (the "Department") received information that Kelson's tenant, George, was operating an MMDF on the Property, in violation of the Lincoln County zoning rules and the moratorium established by Ordinance No. 475. As further set forth in the attached Exhibits 2 and 3, respectively, the Department provided notice of the violation to both Kelson and George on or around May 16, 2014."
It was not until October 2014 that the County served a search warrent yet never closed the legal licensed facility that had been in operation since 3-3-2014 our first day of Medical Cannabis accrss for Oregon.
As was stated before Onno was consulted 2-10-14 as was admitted in future planning commission meeting.
We were in the mix of fighting against the illegal targeting of only our facility by the assertion of this fraud we never consulted planning department first and Lincoln County was busy adopting emergency measures beyond their legal scope so they had to recall the illegal moratorium and chose to then just zone us out. While changing regulations for another.
"As set forth in the attached Exhibit 5, the Board rescinded Ordinance No. 475 and adopted Ordinance No. 479 in its place, creating temporary regulations for MMDFs, on April 29, 2015. Ordinance No. 479 allows MMDFs in General Commercial (C-2) and Retail Commercial (C-1) zones—subject to special standards set forth in the ordinance—and in Planned Industrial (I-P) zones upon conditional use approval. Ordinance No. 479 does not authorize MMDFs in C-T zones."
Ordinance No. 479 does not authorize MMDFs in C-T zones Which Zoned us out but we were here long before all of these targeted actions by Lincoln County Corrupt elected officials using Onno Husings fraud.
We were scheduled to trial June 7-8th 2017 finally and the week before, my attorney drew up supeonas and they were served on camera in the Lincoln County Board of Commissioners meeting on May 31st 2017. Court was scheduled for June 7-8th cancelled and a Summery Judgment was written against me without a day of Cross exam.
New hearings were scheduled and a appeal was to be filed by my attorney.
This was basically the last open discussion I had because I was to attend a Native ceremony to honor my daughter killed 11-11-2016 . So I returned home 7-3-17 and was met with an eviction notice for out medical facility after years of buisness serving sick patients.
On July 5th I attended the Lincoln County Board of commissioners meeting where I stood up and removed my dress and stood in my old lady underware and sport bra to state" you took everything from me so you may take the clothes off my back but you will never take my integrity. Little did I know they would break me.
My Lawyer Mr. Moule had told me the only legal standing was at that address and without the building I had no legal standing, so my Son and I began to sell off everything at a huge loss. We had our last day September 1st 2017. But Kelson and the County had other plans.
Aug. 10th 2017 a hearing was held and I was never informed. We were busy packing and the Courts sent me a transcript of that and the Lincoln County Commissioners Meeting where the illegal vote was taken. I never reviewed due to the loss of legal representation until this year. In this 8-10-2017 the first thing Judge Branford asks is who is present. Mr. Moule and Tobias Tingleaf were on the call clearly along with Kellon Norwood for Lincoln County.
It goes on to reveal that Judge Branford had not truly reviewed the record prior to this call.He states in a conversation he had no idea that Doug Hunt was one of only two votes to ban our facility. We have been asserting this was based upon a fraud by the planning department in filings over and over yet the Judge states if Cindy George was stating the facts? Calling my integrity into question over and over in court filings.
On 2-24-2017 Onno Husing filed Case No. 16CV16925 DECLARATION OF ONNO HUSING IN SUPPORT OF PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT
" In or around May 2014, my office received notice that Going Green had commenced operating an unauthorized MMDF at the Property. On or around May 16, 2014, I provided notice to Kelson that the MMDF violated the County's rules regarding Tourist Commercial zones, the moratorium, and the Resolution of Intent. A true and correct copy of the May 16, 2014, letter to Kelson is attached as Exhibit 5."
Once again he has committed fraud by claiming he learned only after we opened our medical facility which is a lie!
Pre Trial Order June 8th reset the trial until Oct.11-13 yet I was never informed they set a new trial, This resulted from the supeonas served in May 31 2017 for the June trial so it was postponed immeadiatly by Judge Branford until October which I was never informed instead I was given an eviction so the legal teams could decide the fate of my facility without persuing justice for the illegal taking of a legal licensed medical facility.
Aug 10th 2017 Judge Branford, Tobias Tingleaf, Kellon Norwood and David Moule held a hearing where not one defense of the lies already told and submitted into the record was never questioned nor was my lawyer even recorded as being in attendence in the 160 page Summery of Judgment signed by Judge Branford prepared by Miller Miller Graham and Nash represented by Kellon Norwood, It is clear that my legal rights to be represented was violated by both Mr. Moule and his silence and Tobias Tingleaf asserting my lack of legal council as my lawyer sat in silence.
September 08, 2017 another appeal was filed after I was removed from the building and no contact from anyone yet Mr Tingleaf files an appeal as unrepresented and at the post office box. Final page notes Pro Se and sent to post office box.All the following filings in my name were from previous filings. Each one written for the trial that was postponed and prior to the false testimonies submitted into the record. All declarations in the appeal were taken from a previous record because

David Moule is on record withdrawing from representation on 9-4-2017 and had obviously joined up to throw the case together with nthe Judge 8-10-2017.
Not one of these legal authorities acted out of respect for the rule of law.
As a elderly women who has spent my life trying to serve others, this corruption of lawyers and Judges let alone the elected officials spending your tax money has been beyond stressful and financially ruined our future for years to come. As of 9-1-2017 I have lost $1500 a day in revenue let alone the loss of my reputation as a highly regulated medical service destroyed in a collaberated effort by Lincoln County Commissioners, Planner Onno Husing, Legal Wayne Belmont with help from lawyers without integrity.
