NEW REPORT: Nearly 40% of health insurance plans use policies that prevent copay assistance from counting toward patient out-of-pocket costs.

Our 2026 analysis reveals that copay accumulator adjustment policies (CAAPs) are widespread across individual marketplace plans, making it harder for patients with chronic illnesses to afford life-saving medications.

Key findings:
- 26 states + DC + Puerto Rico have laws restricting CAAPs
- 31 states still have plans using these policies
- A 2023 federal court ruling should limit CAAPs, but HHS hasn't enforced it

Black and African American communities in the US are disproportionately impacted by HIV. CDC reports 38% of new HIV diagnoses occurred in Black and African American people, despite only making up 12% of the national population. We must work harder to eliminate HIV-related stigma and discrimination, and find ways to improve access to HIV testing, prevention, and treatment for Black and African Americans.
