Social Security's rules regarding proving disability favor persons who are age 50 or over. For those persons it is much easier to prove disability than for persons who are age 49 and younger.

SOCIAL SECURITY DISABILITY DENIALS: DOES EVERYONE GET DENIED THE FIRST TIME ?

Most people have heard the old adage that " everyone gets denied at first" when applying for Government Disability---more correctly called Social Security Disability (SSD.)
This is not actually correct.
The actual nationwide denial rate is around 65% for the first application...meaning you have a 35% chance of winning the case by simply filing an application for benefits.
Obviously the odds are against you in the beginning.

The GOOD NEWS is that on appeal, the 65% goes the other way: 65% of cases that have been appealed then result in an award. (Nationwide average.)The bad news : Appeals take up to a year and a half to be heard!

(Interestingly, the fees that are payable to attorneys are based upon the retroactive number of months and the amount of retroactive payments that are recovered. The more retroactive money recovered, the closer the attorney can get to receiving the maximum fee which is usually $6000. This means many attorneys won't even TAKE a case at the application stage because there won't be enough retroactive money if they win right away!)

We have filed MANY applications for disabled clients that are accepted IMMEDIATELY without having to appeal and/or go in front of a SSD Judge!

Dan's Workers' Compensation Tip of the Month
Federal Workers (postal worker/ letter carriers, or persons who works for the IRS are examples) DO NOT receive regular State Workers' Comp benefits. There is a separate Workers' Comp system for Federal workers who are injured on the job and few if any attorneys, unfortunately, take these cases.

WORKERS' COMP BENEFITS---WHAT DO I GET?
Most injured workers assume that Workers' Comp pays them weekly checks if they are out of work due to an on-the-job injury. That's a given.
But are there OTHER benefits that Workers' Comp pays out?
You bet.
Here is a summary of the law----------- and the types of awards that injured workers routinely receive when they are injured at work!

1. Biweekly payments, tax-free, when injured workers are out of work longer than 7 days.

2. Lump sum awards for permanent injuries even if there is no time lost from work!

Example: Lou injures his shoulder lifting a box in his job. Lou is found by his doctor, one year later to have sustained a permanent loss of use of 20% of his arm as a result. If Lou earned $900 per week in salary before the accident then he would be entitled to $37,440, tax-free for his injury even if he never loses time from work!

3. Full reimbursement for all out of pocket expenses including travel to and from all health providers who treat the work-related injuries.

4. Restoral of used sick time

5. Penalties against insurance carriers if they do not pay awards within certain time periods.

You can receive BOTH Workers' Compensation and Social Security Disability benefits at the same time. But you have to prove each case separately. Winning one case does not help you win the other. The two benefits have different rules---and don't forget, Workers' Comp is a STATE system but Social Security is run by the Federal Government.

OCCUPATIONAL ILLNESSES: WORKERS' COMP PUZZLES
You may have recently read the Daily News story about Diane DiGiacomo, an ex-ASPCA worker who is dying from a 9/11- related cancer. She "spent three months near the shadow of the smoldering....World Trade Center saving dogs and cats left behind in nearby apartments." As a result, she is now gravely ill.
The News article goes on to detail how the New York Workers' Compensation Board, shockingly, denied Diane's Workers' Comp claim.
I do not know all of the details, (it wasn't our case) but suffice it to say this is a sad story.
Occupational illnesses of all kinds can be difficult to prove at the Workers' Compensation Board. The Attorney General Eric T. Schneiderman's own website explains it this way:
Consider this example. A nurse who contracts tuberculosis from a tubercular patient would be entitled to benefits for an occupational disease because it is an ordinary feature of a nurse's employment to be exposed to persons suffering from such diseases/ However, an office worker who contracted tuberculosis for being exposed to a co-worker would not be considered to have contracted an occupational disease because there is nothing in the nature of office work which would expose all persons doing that type of work to tuberculosis.

If you know someone who suffers an illness as a result of the work they do, have them call an experienced New York Workers' Compensation attorney who can advise them of their rights!
